For inspection, safety and technical consultants: a $5M requirement means $5M per claim and $5M aggregate, usually met with a primary policy plus follow-form excess.
The short answer
- A $5M requirement usually means $5M per claim / $5M aggregate, often met with a smaller primary policy plus excess layers (extra policies that sit above the first).
- It is uncommon for inspectors, and usually comes from large energy, industrial or government work.
- $5M is very rare online and usually needs a broker, who can ask several types of insurers for quotes, including excess and surplus lines insurers (insurers that write harder-to-place risks). Morrow can help you find it.
What does a $5M requirement mean for inspection, safety and technical consultants?
Professional Liability (E&O, short for Errors and Omissions) covers claims that your inspection, test or report caused a client a financial loss. Hypothetically, a weld you passed later fails. A $5M clause might read like this:
Illustrative contract wording
Consultant shall carry Professional Liability insurance for inspection, testing and related services with limits of not less than $5,000,000 per claim and $5,000,000 in the aggregate. Coverage shall be claims-made, with a retroactive date on or before the first date of services, and remain in force for five (5) years after final acceptance. Limits may be satisfied by primary and excess insurance.
Illustrative example only. Your contract's wording controls.
- Per claim and aggregate: the most paid for one claim, and for all claims in one policy year. Both must reach $5M. See how limits are written.
- Claims-made: the policy covers claims made and reported while it is active, for work done after the retroactive date (the earliest date of work the policy covers).
- Five years after the job: you would usually renew every layer, with the same retroactive date.
- Primary plus excess: this clause allows it. If yours is silent, confirm with the client that primary plus follow-form excess meets it.
Who asks inspection, safety and technical consultants for $5M?
Many clients ask for $1M or $2M. A $3M clause is a middle step, and $10M is rarer still. $5M shows up when one missed finding could cause a huge loss:
- Energy and utility companies hiring third-party inspectors for refineries, pipelines or power plants.
- Large construction and infrastructure projects needing special inspection or testing.
- Major manufacturers using outside testing labs for critical parts.
- Government agencies on large contracts, often set in the request for proposal (RFP).
How is $5M built?
Most inspection, safety and compliance consultants buy Miscellaneous Professional Liability, a form for service firms without their own policy type. Licensed engineers usually need Architects and Engineers (A&E) Professional Liability.
A primary policy pays first. An excess policy pays only after the layer below it is used up. "$3M xs $2M" means a $3M layer that sits above the first $2M. Stacked layers are often called a tower.
Example A: one policy
Example B: two layers
Example C: three layers
For smaller inspection and testing firms, a single $5M primary is very rare online and usually needs a broker. Morrow can help you find it. A common route is a smaller primary plus excess layers. Each excess layer should follow form, meaning it adopts the primary policy's terms. Match the retroactive date, policy period and named insured (the business the policy covers) on every layer so there is no gap.
Many Professional Liability policies pay defense costs inside the limit, so legal fees can use up part of the $5M. A commercial umbrella almost never counts toward this limit.
Good to know
Moving up from a lower limit? Request new quotes through Morrow for a higher primary or for excess layers. Ask to keep your retroactive date where the market allows. Report known incidents to your current insurer before you switch.
What will underwriters ask for?
An underwriter decides whether to offer coverage and on what terms. Each insurer in the stack may review your firm:
- Your services, such as inspection, testing or safety audits, with revenue from each.
- The contract that needs $5M, including what you inspect and its value.
- Staff credentials and report review.
- Your client agreement, including any limitation of liability clause (a cap on what you owe a client).
- Five years of loss runs (a report listing past claims), any known incidents, and your current policy with its retroactive date.
What affects the cost?
- What you inspect. Energy sites and critical parts often cost more to insure.
- How the layers are built. The primary layer usually costs the most per $1M. Higher excess layers usually cost less.
- Revenue, project size and claims history. Larger inspection projects and past report disputes can raise price.
- Retention and defense terms. Retention is what you pay per claim before the insurer pays, like a deductible. A higher one usually lowers premium. Defense outside the limit usually costs more.
Frequently asked questions
Can a small inspection or safety consulting firm get $5M in Professional Liability?
Sometimes, depending on underwriting, revenue, claims history and contract size. It is often built as a $1M or $2M primary plus excess. Approval is never certain, and very small firms may find $5M hard to place. Morrow can help you find it.
Can my client be added as additional insured on my $5M Professional Liability?
Not automatically. Additional insured means adding someone to your policy so it protects them too. Some insurers will add a client, limited to claims arising from your services, but not every insurer or layer will. If your contract requires it, flag that before quoting and confirm it on every layer. Clients often accept a certificate of insurance (a one-page proof of coverage) listing every layer.
Is $3M enough if my inspection contract says $5M?
Usually not. If the clause says $5M, the total across all layers needs to reach $5M. Primary plus follow-form excess can get there. Confirm with the client that this meets the clause.
