$10M Professional Liability (E&O) Insurance for Inspection, Safety and Technical Consultants

In this guide

A $10M Professional Liability requirement for inspection, safety and technical consultants usually means a primary policy plus excess layers, and it often comes from energy, infrastructure and government clients.

The short answer

  • A $10M Professional Liability (E&O) requirement for inspection and safety consultants is rare, usually comes from large energy, infrastructure or government clients, and is often met with a primary plus excess layers.
  • It is often built as a tower: a primary policy plus excess layers (extra policies that pay after the first one is used up).
  • $10M is very rare online and almost always needs a broker to place it. Morrow can help you find it.

What does a $10M requirement mean for inspection and safety consultants?

Professional Liability (E&O, short for Errors and Omissions) covers claims that your inspection, test, report or advice caused a client a financial loss, and on some forms injury or damage. A clause might read:

Illustrative contract wording

Contractor shall maintain Professional Liability insurance covering inspection and testing services with limits of not less than $10,000,000 per claim and in the annual aggregate. Claims-made coverage shall carry a retroactive date no later than the start of services and be maintained for five (5) years after completion. Limits may be met through primary and excess policies.

Illustrative example only. Your contract controls.

  • Per claim and aggregate: the most paid for one claim, and for all claims in a year. See how limits are written.
  • Claims-made: Professional Liability almost always covers claims made and reported while the policy is active, for work after the retroactive date (the earliest work date covered).
  • Five years after the job: you would usually renew every layer, with the same retroactive date, for those five years. If you stop renewing, an extended reporting period (a tail, or extra time to report claims after a policy ends) may be offered for an added cost. Some contracts do not accept a tail, so check the policy and the contract.
  • Primary plus excess: this clause allows a stack. If yours is silent, confirm with the client that primary plus follow-form excess meets it.

Who asks inspection and safety consultants for $10M?

Many clients in this group ask for $1M or $2M. $10M shows up when one missed finding could cause a huge loss or injury:

  • Oil, gas, chemical and utility owners, some of which use one standard contract for all inspectors.
  • Infrastructure programs, such as transit or bridges.
  • Manufacturers relying on outside labs to test critical parts.
  • Federal and state agencies on inspection, compliance or security contracts, which may state the limit in the request for proposal (RFP).

How is $10M built?

Many inspection and safety consultants buy Miscellaneous Professional Liability, a general form for service firms. Licensed engineers usually need Architects and Engineers (A&E) Professional Liability. Inspection claims often allege bodily injury or property damage after a missed finding, and many Miscellaneous forms exclude or limit that. An A&E or technical-services form may fit better.

The primary policy pays first. "$5M xs $5M" means a $5M excess layer above the first $5M.

A $5M requirement may be met with one primary policy. At $10M, the limit is more often split across layers.

Example A: two layers

Excess layer$5M xs $5M
Primary policy$5M / $5M
Total: $10M / $10M

Example B: three layers

Second excess$5M xs $5M
First excess$3M xs $2M
Primary policy$2M / $2M
Total: $10M / $10M
Each block is a separate policy.

Each excess layer should follow form, meaning it adopts the primary policy's terms. Match the retroactive date, policy period and named insured (the business covered) on every layer. Many Professional Liability policies pay defense costs inside the limit. A commercial umbrella (extra coverage above general liability and auto policies) almost never counts toward this limit.

Good to know

Only one job needs $10M? A project-specific Professional Liability policy, where available, covers only that job. It is rarely found online. Morrow can help you find it.

What will underwriters ask for?

Each underwriter (the insurer's risk reviewer) may ask for:

  • Your services (inspection, testing, safety audits, forensic work), revenue from each, and the $10M contract.
  • Whether you certify work, and who reviews reports.
  • Staff and subcontractor credentials (for example non-destructive testing, or NDT, or weld inspection certifications).
  • Your client agreement, including any limitation of liability clause (a cap on what you owe).
  • Five years of loss runs (a report of past claims) and known incidents.

What affects the cost?

  • What you inspect or test. Energy sites and critical parts usually cost more than general safety work.
  • How the tower is built. The primary layer usually costs the most per $1M. Higher excess layers usually cost less.
  • Claims history. Past claims can raise the price or cap the limit.
  • Retention and defense terms. Retention works like a deductible, and a higher one usually lowers premium.

Frequently asked questions

Do I need $10M Professional Liability as an inspection or safety consultant?

Only if your contract or RFP requires it. A small firm may be declined or offered less, so send the contract to Morrow before you bid.

I have $2M. How do I get to $10M as an inspection firm?

Ask Morrow to request quotes for excess layers or a new, higher primary, keeping your retroactive date and prior acts coverage where the market allows. Report known incidents to your current insurer first.

Can my client be added as additional insured on my $10M Professional Liability?

Sometimes, but it is often limited or declined. Additional insured means adding someone to your policy. Some carriers add a client when the contract requires it, usually only for liability from your services, and each excess layer would need to follow it. A certificate of insurance (a one-page proof of coverage) shows coverage but does not make the client an insured, so ask what the client accepts.

How long does it take to get $10M Professional Liability quoted as an inspector?

A tower often takes longer to quote than a single policy, because each layer is reviewed on its own. Sending your contract and policy early may help.

Looking for $10M in Professional Liability? Morrow can help.

Send us the insurance requirement from your contract and your current policy. Morrow can review both and request quotes for a tower or a project-specific policy.
