For inspectors, testing labs and safety consultants: if your contract asks for $3M, you usually need $3M per claim and in total, from one policy or from a primary policy plus an added excess policy.
The short answer
- A $3M requirement usually means your Professional Liability (E&O) must pay up to $3M per claim and in total, often through one $3M primary policy or a $1M or $2M primary plus follow-form excess.
- Many clients in this group ask for $1M or $2M. $3M usually comes from energy work, large projects, some insurers and law firms, and government contracts.
- $3M is rarely available online for inspection, testing or safety work. It is usually placed by a broker. Morrow can help you find it.
What does a $3M requirement mean for inspection and safety consultants?
Professional Liability (E&O, short for Errors and Omissions) covers claims that your inspection, test result or advice caused a client a financial loss. Picture a hypothetical client claiming a wrong lab result forced it to scrap a batch. A clause might read:
Illustrative contract wording
Consultant shall carry Professional Liability insurance for inspection, testing and auditing services, with limits of not less than $3,000,000 per claim and in the aggregate. Limits may be met by a primary policy and excess policies. Any claims-made policy shall have a retroactive date on or before the first date of services.
Illustrative example only. Your contract's wording controls.
- Per claim and aggregate: the most paid for one claim, and for all claims in one policy year. Here, $3M each.
- Combining policies: in this sample, the second sentence lets you stack a primary and excess policy. Not every contract does, so confirm with the client that your own clause allows it.
- Claims-made: Professional Liability almost always covers claims made and reported while the policy is active, for work after the retroactive date (the earliest covered work date).
Who asks inspection and safety consultants for $3M?
Many contracts in this group ask for $1M Professional Liability for inspection and safety consultants or $2M. $3M is a step up from $2M, often set by the owner of a large project or product run. It may come up here:
- Energy and utility work, such as inspecting plants, pipelines and large equipment.
- Large construction or industrial projects, where an owner sets one limit for every inspection firm.
- Testing labs whose results decide whether a large batch ships.
- Insurers and law firms retaining forensic consultants on large losses.
- Government agencies where the limit is set in the request for proposal (RFP).
The form matters too. Many inspection and safety consultants buy Miscellaneous Professional Liability, a general policy for advice firms. Licensed engineers usually need Architects and Engineers (A&E) coverage.
How is $3M built?
A primary policy pays first. An excess layer is a separate policy that pays only after the primary limit is used up. "$1M xs $2M" means $1M above the first $2M.
Option 1: one policy
Option 2: primary plus excess
A stacked setup (a primary policy plus excess layers, often called a tower) is another way to reach $3M, for example when one $3M primary policy is not a good fit or is hard to place. The excess should follow form, meaning it uses the primary policy's terms and adds limit. A commercial umbrella almost never covers Professional Liability, so it does not count here.
For a lab or third-party inspector, ask whether the excess follows the primary wording for testing and certification work. A gap between layers can leave part of a $3M clause unmet.
If you carry $1M or $2M today, Morrow can request new quotes for a $3M primary policy or for excess layers, keeping your retroactive date where the market allows.
Good to know
Report first, then switch. Report known incidents to your current insurer before you switch. A new policy usually excludes them.
What will underwriters ask for?
- Your services by share of revenue: inspection, testing, auditing, forensic or safety work.
- Your lab accreditations, inspector certifications and any work needing an engineer's stamp.
- How you review and sign reports, and whether you certify anything as safe.
- The contract requiring $3M, including the indemnity section (who pays if something goes wrong).
- Subcontracted labs or inspectors, and how you check them.
- Loss runs (your claims history report) and your current retroactive date.
What affects the cost?
- Type of work and contract size. Testing tied to energy sites or large product runs usually costs more to insure than general advice.
- Structure. The primary layer usually carries the most cost. Quoting a single $3M policy and a primary-plus-excess setup side by side shows which structure fits your budget.
- Claims history. Past claims can raise the price.
- Retention and defense terms. The retention works like a deductible, and a higher one usually lowers premium. Many policies pay defense costs inside the limit, so legal fees can use it up.
Frequently asked questions
Do I need $3M Professional Liability as an inspection or safety consultant?
Only if your contract or RFP requires it. Check the clause first.
Can my client be added as an additional insured on my $3M Professional Liability?
Usually not. An additional insured is a party added to your policy, and that is not standard on Professional Liability. A certificate of insurance (one-page proof of coverage) does not make the client an additional insured. If your contract requires it, send it to Morrow so we can review the wording and request quotes.
Is $2M enough if my contract says $3M?
No, not if the clause says $3M. A $2M primary plus $1M follow-form excess reaches $3M, if your clause allows stacked policies.
What if a later contract asks for $5M?
It may be possible to add another excess layer, depending on the market. Limits of $5M and above are very rare online and usually need a broker. Morrow can help you find it. See $5M Professional Liability for inspection and safety consultants.
Looking for $3M in Professional Liability? Morrow can help.
Send us your contract requirement and current policy. Morrow can review both and request quotes for one $3M policy and for primary plus excess, keeping your retroactive date where the market allows.
