$3M Professional Liability (E&O) Insurance for Tutors, Trainers and Education Consultants

In this guide

For tutors, trainers and education consultants facing a $3M contract requirement: you can usually meet it with one $3M Professional Liability policy, or with a smaller primary policy plus excess limit.

The short answer

  • A $3M requirement usually means $3M per claim and $3M aggregate in Professional Liability (E&O), met by one $3M policy or by a primary policy (the first to pay) plus excess, if your contract allows it.
  • Professional Liability is almost always claims-made, which means it covers claims made while the policy is active, so you need to keep it in force.
  • $3M is rarely available online and is usually placed by a broker. Morrow can help you find it.

What does a $3M requirement mean for tutors, trainers and education consultants?

Professional Liability (E&O, short for Errors and Omissions) covers claims that your teaching, training or advice caused a client a financial loss. A $3M clause might read:

Illustrative contract wording

Vendor shall maintain Professional Liability insurance with limits of not less than $3,000,000 per claim and $3,000,000 in the annual aggregate. Coverage shall be maintained for three (3) years after the services end. Limits may be satisfied by a combination of primary and excess policies.

Sample wording for illustration only. Your contract's wording controls.

  • Per claim and aggregate: the most paid for one claim, and for all claims in one policy year. See how limits are written.
  • Retroactive date: the earliest date of work the policy covers. Every layer should share it, and you would usually keep every layer in force for the years named.
  • Primary plus excess: the last sentence allows stacked policies. If your clause is silent, confirm with the client that a primary plus excess structure meets it.

Who asks tutors, trainers and education consultants for $3M?

The limit usually reflects the client's size and risk more than yours. $3M often shows up with:

  • Large school districts buying tutoring or test prep across many schools.
  • Universities hiring outside trainers or admissions consultants.
  • Government training contracts, where the request for proposal (RFP) often sets the limit.
  • Large corporate clients with standard vendor terms for leadership or sales training.
  • Safety and compliance training for industrial or construction clients. Injury claims from a missed topic are often excluded or restricted under Professional Liability and may need specialty placement. Financial-loss claims, such as fines, fit better.

How is $3M built?

A primary policy pays first. An excess layer is a separate policy that pays only after the primary limit is used up. "$1M xs $2M" means a $1M layer sitting above the first $2M.

Option 1: one policy

Primary policy$3M / $3M
Total: $3M per claim / $3M aggregate

Option 2: $2M primary plus excess

Excess layer$1M xs $2M
Primary policy$2M / $2M
Total: $3M per claim / $3M aggregate

Many tutors, trainers and consultants buy Miscellaneous Professional Liability, a form for service businesses. If your main product is a learning platform or software, you may need Technology E&O instead.

An excess layer should follow form. That means it uses the primary policy's terms and only adds limit.

If you already carry $1M or $2M, Morrow can request new quotes for a $3M primary or for excess layers, and ask carriers to keep your retroactive date and prior acts coverage (coverage for work done before the new policy starts) where the market allows. A commercial umbrella (a policy that adds limit above general liability) almost never counts toward this limit (here is why).

Compared with $2M or $1M, a $3M clause usually means adding an excess layer or moving to a new $3M primary, since a $2M policy alone falls $1M short. If your contract asks for $2M instead, see $2M Professional Liability for tutors and trainers. If it asks for $5M or more, a broker is almost always involved, see $5M Professional Liability for tutors and trainers. Morrow can help you find it.

Good to know

Working with minors? Many Professional Liability policies exclude abuse and molestation claims. A district or university contract may ask for separate abuse and molestation coverage.

What will underwriters ask for?

Expect to provide:

  • An application listing your services and the revenue share of each.
  • Past and expected revenue, plus your largest clients.
  • How many instructors you use, including contractors, and how you screen and supervise them.
  • Whether you work with minors or online, and whether you promise results such as score gains.
  • The $3M clause, three to five years of loss runs (a report of past claims), and your current retroactive date.

What affects the cost?

  • Type of service. Admissions consulting may cost more to insure than general tutoring, because mistakes can lead to bigger losses. Safety training with injury exposure may need specialty terms.
  • Revenue and staff. More students, trainers and large contracts mean more chances for claims.
  • How the $3M is built. The primary layer often costs the most because it pays first.
  • Claims history. Past claims can raise the price or shrink the limit offered.
  • Retention and defense terms. Retention is what you pay on each claim before the policy pays, like a deductible. Many Professional Liability policies pay defense costs inside the limit.

Frequently asked questions

Is $2M enough if my contract says $3M?

No, a $2M policy alone does not meet a $3M clause. A $2M primary plus a $1M follow-form excess layer can, if the clause allows primary plus excess. Confirm with the client first.

Can the school district be added as an additional insured?

Usually not. Most Professional Liability policies do not let you add a client as an additional insured (a person or group added to your policy for their own protection). A few may offer limited wording, and the carrier decides. Where offered, it usually covers only the client's liability from your services, and it would be needed on every layer. Ask the client what the contract requires, and send Morrow the clause to review.

I am switching to a $3M Professional Liability setup. What should I do about my current policy?

Keep your current policy in force until the new coverage starts. Report anything that could become a claim to your current carrier before that policy ends.
