Tutors and trainers asked for $2M by a school district or large employer should know it usually means $2M on each claim, so a $1M/$2M policy may fall short.
The short answer
- A $2M Professional Liability (E&O) requirement for tutors and trainers usually means $2M per claim / $2M aggregate (the most the policy pays for one claim, and for all claims in one policy year). A $1M/$2M policy pays only $1M on any one claim, so it may not meet the clause.
- Larger clients, such as school districts, universities, government training contracts and large employers, may ask for $2M.
- If you carry $1M today, request new quotes for a $2M policy through Morrow. Ask to keep your retroactive date (the earliest work date your policy covers) where the market allows. A true $2M per claim limit can be harder to find than $1M. Morrow can help you find it.
What does a $2M requirement mean for tutors and trainers?
Professional Liability (E&O, short for Errors and Omissions) covers claims that your teaching, training or advice caused a client a financial loss. A $2M clause often reads like this:
Illustrative contract wording
Vendor shall maintain Professional Liability insurance with limits of not less than $2,000,000 per claim and $2,000,000 in the annual aggregate for the services under this Agreement. If written on a claims-made basis, the retroactive date shall be on or before the start of services, and coverage shall be kept in force for three (3) years after the Agreement ends.
Illustrative example only. Your contract's wording controls.
- Per claim and aggregate: this clause asks for $2M on both, so check both numbers on your policy.
- Check the per claim limit. A certificate of insurance (proof of coverage) may show "$2M" as the aggregate only.
- Claims-made: Professional Liability almost always covers claims made and reported while the policy is active, for work done after the retroactive date. See Professional Liability limits explained.
Who asks tutors and trainers for $2M?
Some clients in this group ask for $1M Professional Liability for tutors and trainers. $2M tends to show up when the client is large or public:
- School districts hiring tutoring, test prep or curriculum providers across many schools.
- Universities bringing in admissions, advising or training consultants.
- Government agencies buying workforce, safety or compliance training, often with the limit written into the request for proposal (RFP).
- Large employers rolling out leadership or compliance training, where the master services agreement (the main contract that sets terms for all work) may apply one insurance schedule to every vendor.
- Construction and industrial firms hiring safety trainers for large sites.
How is $2M built?
Tutors and trainers often buy Miscellaneous Professional Liability, a form for service businesses. If your main product is an online learning platform or software, you may need Technology E&O instead.
A contract may want one primary policy (the policy that pays first) at $2M/$2M. Some allow a $1M primary plus a $1M excess layer (a second policy that pays after the first limit is used up). Many require the full limit on one policy.
Excess should follow form, meaning it uses the primary policy's terms and retroactive date. Confirm with the client that primary plus follow-form excess meets the clause. A commercial umbrella almost never counts toward this limit. If a contract asks for more than $2M, see $3M Professional Liability for tutors and trainers.
Good to know
Defense costs can shrink the limit. Many Professional Liability policies pay defense costs inside the limit, so legal fees reduce what is left to settle a claim. The policy's limits of liability section, and sometimes the declarations page (the policy summary), shows how yours works.
What will underwriters ask for?
An underwriter is the person at the insurer who decides whether to offer coverage. At $2M, expect more questions than for a basic policy:
- Your services, such as tutoring, test prep, admissions consulting or safety training, with a rough share of revenue from each.
- The contract asking for $2M, the client type, and the size of the work.
- How many instructors you use, including independent contractors, and how you supervise them.
- Whether you work with minors, and your background checks.
- Whether you promise results, such as score gains or certification passes.
- Loss runs (a report listing past claims), known incidents, and your current policy and retroactive date.
What affects the cost?
- Type of service. Safety training and admissions consulting may cost more than general tutoring.
- Revenue and contract size. Large contracts mean bigger possible losses.
- Number of instructors. More instructors mean more chances for a claim.
- Claims history. Prior claims can raise the price or limit offers.
- Policy design. A higher retention (the amount you pay per claim before the policy pays, similar to a deductible) usually lowers premium. Defense outside the limit usually adds cost.
Frequently asked questions
I carry $1M. Is that enough if my school district contract says $2M?
Usually not. A $1M per claim limit is below a $2M per claim clause. Send Morrow your contract and policy. Morrow can request quotes for a new $2M primary policy or an excess layer that keep your retroactive date and prior acts coverage (coverage for work done before the new policy starts) where the market allows. Start early so there is no gap, and report any known incidents to your current carrier before switching.
Can a school district be an additional insured on my Professional Liability?
Usually not. Additional insured means adding someone to your policy so it protects them too. Many Professional Liability policies do not add anyone by default, and wording varies by form. Some contracts ask for it anyway, so check what yours requires. If your contract also asks for General Liability additional insured status, that is a separate request on your General Liability policy and does not give the district Professional Liability protection. Send your contract to Morrow for review when quotes are requested.
Does Professional Liability cover abuse claims if I tutor minors?
Usually not. Many policies exclude abuse and molestation claims. If you work with minors, ask about separate coverage and check whether the contract names a limit for it.
