$10M Professional Liability (E&O) Insurance for Tutors, Trainers and Education Consultants

In this guide

For tutors, trainers and education consultants: a $10M Professional Liability requirement usually comes from very large clients and is almost always met with a primary policy plus excess layers.

The short answer

  • A $10M requirement means your Professional Liability (E&O) limit must reach $10M, and for tutors, trainers and education consultants it usually comes from very large corporate, government or safety training clients.
  • It is almost always built as a tower: a primary policy plus excess layers stacked above it.
  • $10M is very rare online and almost always needs a broker to place each layer. Morrow can help you find it.

What does a $10M requirement mean for tutors, trainers and education consultants?

Professional Liability (E&O, short for Errors and Omissions) covers claims that your teaching, training or advice caused a client financial loss. A $10M clause might read:

Illustrative contract wording

Contractor shall maintain Professional Liability insurance covering the training and consulting services under this Agreement, with limits of not less than $10,000,000 per claim and $10,000,000 in the annual aggregate, which may be met through primary and excess policies. If written on a claims-made basis, coverage shall be maintained for three (3) years after the services end.

Sample wording for illustration only. Your contract's wording controls.

  • Per claim and aggregate: the most paid for one claim, and for all claims in one policy year. This clause asks for $10M/$10M. See how limits work.
  • Claims-made: Professional Liability almost always covers claims made and reported while the policy is active, for work done on or after the retroactive date (the earliest work date covered).
  • After the work ends: you would usually keep every layer in force.
  • Primary plus excess: this wording allows stacked policies. If yours is silent, confirm with the client that primary plus follow-form excess meets it.

Who asks tutors, trainers and education consultants for $10M?

Tutors, trainers and education consultants are often asked for lower limits. A $10M requirement usually reflects the client's size and tends to come from:

  • Very large corporate clients with one master service agreement (MSA) for every training vendor.
  • Government contracts, where the limit may sit in the request for proposal (RFP), the public document asking vendors to bid.
  • Safety and compliance training for energy, industrial or construction clients.
  • Large school districts and universities, which typically ask for lower limits. A $10M clause from one is unusual, so read it closely.

A $5M requirement may need fewer layers, and $3M may need only one. See the $5M guide and $3M guide.

How is $10M Professional Liability built?

A primary policy pays first. Each excess layer is a separate policy that pays only after the layers below it are used up. "$5M xs $5M" means a $5M layer above the first $5M.

Example A: two layers

Excess layer$5M xs $5M
Primary policy$5M / $5M
Total: $10M per claim / $10M aggregate

Example B: three layers

2nd excess layer$5M xs $5M
1st excess layer$3M xs $2M
Primary policy$2M / $2M
Total: $10M per claim / $10M aggregate
Hypothetical examples only. Each block is a separate policy.

Tutors, trainers and education consultants often buy Miscellaneous Professional Liability, a form for service businesses without their own policy type. If your main product is a learning platform or software, you may need Technology E&O (errors and omissions for software and technology services) instead. Each excess layer should follow form: it uses the primary policy's terms and only adds limit.

If only one engagement needs $10M, Morrow can also request quotes on a project-specific Professional Liability policy where available. It covers just that engagement, so it may have its own limit, depending on the policy wording. If you carry a lower limit now, Morrow can request quotes for a higher primary or excess layers.

Good to know

Working with minors? Many Professional Liability policies exclude abuse and molestation claims. A district contract may ask for separate coverage.

What will underwriters ask for?

Underwriters decide whether to offer coverage. Each layer may need:

  • An application listing your services, revenue by service and your largest clients.
  • Your instructor count, and how you screen and supervise them.
  • Whether you work with minors or promise results, such as score gains.
  • The contract, including the indemnity section (where you agree to pay certain client losses).
  • Loss runs (a report of past claims) and your current policy.

What affects the cost of $10M Professional Liability?

  • Type of service. Safety and compliance training may cost more to insure than general tutoring, because mistakes can cause bigger losses.
  • Size of the program. More students, trainers and contracts mean more claim chances.
  • How the tower is built. The primary often costs the most because it pays first. Excess layers often cost less per dollar of limit.
  • Claims history. Past claims can lower the limit offered, raise pricing or add exclusions.
  • Retention and defense terms. Retention is what you pay on each claim before the policy pays, like a deductible. Many policies pay defense costs inside the limit, so legal fees reduce what is left for a settlement.

Frequently asked questions

Do I need $10M Professional Liability as a tutor or trainer?

Only if your contract or client requires it. Check the insurance clause. Morrow can review it for you.

Can I use my commercial umbrella to reach $10M Professional Liability?

Almost never. A commercial umbrella usually sits above General Liability and auto, not Professional Liability. You usually need excess layers. Read about umbrellas.

Can a school district or university be added as an additional insured on my Professional Liability?

Sometimes, but it is less common than on General Liability. Some forms add a client as an additional insured when a written contract requires it, usually only for the client's liability arising from your services. Not every form or carrier offers this, and a certificate of insurance (a one-page summary of your coverage) does not add them. Check your policy and contract.

Is $5M enough if my contract says $10M?

Not if your contract requires $10M. In most cases the limits need to meet the clause, so confirm with the client that your coverage satisfies it. Morrow can request quotes for a primary plus follow-form excess layers that reach $10M.

Looking for $10M in Professional Liability? Morrow can help.

Send us the insurance requirement from your contract and your current policy. Morrow can review both and request quotes for the primary and excess layers, keeping your retroactive date where the market allows.
