A testing laboratory asked for $5M in Professional Liability can often meet it with a primary policy plus excess layers instead of one $5M policy.
The short answer
- A $5M requirement means your Professional Liability (E&O) must pay up to $5M per claim and per policy year, which a lab often meets with a primary policy plus excess layers (extra policies above it).
- If your lab carries $1M or $2M today, that policy will not stretch to $5M on its own. A new primary or added excess layers are the usual routes.
- $5M is very rare online and almost always requires a broker to approach specialty markets. Morrow can help you find it.
What does a $5M requirement mean for testing laboratories?
Professional Liability (E&O, short for Errors and Omissions) covers claims that your testing or report caused a client a financial loss. A $5M clause might read:
Illustrative contract wording
Laboratory shall maintain Professional Liability insurance covering all testing and certification services, with limits of not less than $5,000,000 per claim and $5,000,000 in the aggregate. Limits may be met by any combination of primary and follow-form excess policies.
Illustrative example only. Your contract's wording controls.
- Both numbers: the most paid per claim and for all claims in a policy year (the aggregate) must each reach $5M.
- Claims-made: Professional Liability almost always covers claims made while the policy is active, for work done on or after the retroactive date (the earliest work date covered).
- "Certification services": if you sign off that a part meets a standard, the client relies on your word.
- Stacking: this clause accepts primary plus excess. If yours is silent, confirm with the client that primary plus follow-form excess meets it.
Who asks testing laboratories for $5M?
A $5M ask tracks the client's possible loss. Asks may come from:
- Aerospace, automotive and medical device makers that release parts based on your results. Hypothetical: a lab passes a bracket that later fails.
- Energy and pipeline companies ordering weld or metallurgy testing.
- Government agencies buying environmental or materials testing, where the limit is often set in the request for proposal (the bid document).
A lab that only reports raw data may face a lower ask than one that certifies a part, so check which role the clause assumes.
How is $5M built?
A primary policy pays first. An excess layer is a separate policy that pays only after the layers below it are used up. Excess layers should follow form, meaning they use the primary policy's terms. "$3M xs $2M" means a $3M layer above the first $2M.
Option 1: one policy
Option 2: primary plus one excess
Option 3: primary plus two excess
A single $5M primary is hard to find, and $5M almost always needs a broker. Morrow can help you find it. Layers often share the same retroactive date and policy period.
At $3M, a lab may still use one primary policy (see $3M for testing laboratories). At $10M you usually need more layers (see $10M).
Labs tied to engineering firms may use an A&E (architects and engineers) form. A commercial umbrella almost never covers Professional Liability, so it usually cannot be counted toward $5M.
Good to know
Defense may come out of the $5M. Many Professional Liability policies pay defense costs inside the limit. Lawyer and expert fees in a dispute over a test result can use up part of the $5M before any settlement. See defense costs.
What will underwriters ask for?
Underwriters (insurer staff who decide on coverage) may ask for:
- Revenue by testing type (materials, environmental, product) and client industry.
- Your accreditations, such as ISO/IEC 17025 (an international lab quality standard).
- Whether you only report data or also certify results.
- How you track samples from receipt to report (chain of custody), how you calibrate equipment, and who reviews reports before release.
- The contract requiring $5M and any limitation of liability clause (a cap on what you owe a client).
- Five years of loss runs (a report listing past claims) and your current policy.
What affects the cost?
- What your results decide. Tests that release product usually cost more to insure than routine checks.
- How the layers are built. The primary layer usually costs the most per $1M.
- Claims history. Past claims can raise cost.
- Retention. This is what you pay per claim before the policy pays, like a deductible. A higher one usually lowers premium.
Frequently asked questions
Is $3M enough if my testing contract says $5M?
No, a clause that says $5M needs $5M per claim and in the aggregate. A $3M policy alone falls short, though a $3M primary plus a $2M excess layer would reach $5M. Confirm with the client that primary plus follow-form excess meets the clause. Because $5M almost always needs a broker, Morrow can help you find it.
My lab has $2M today. How do I get to $5M?
A lab with $2M today usually reaches $5M by getting new quotes for a $5M primary policy or for follow-form excess layers above a primary. Morrow can request those quotes, keeping your retroactive date and prior acts coverage (cover for earlier work) where the market allows. Report any known problem with past work to your current insurer before you switch.
Can my client be added as an additional insured on my lab's Professional Liability?
Usually not. Professional Liability covers claims made against you for your own work, and adding anyone else is not standard. A certificate of insurance (one-page proof of coverage) generally only reports your coverage and usually gives the holder no rights under the policy.
How long does it take to place $5M Professional Liability?
Placing $5M often takes longer than a smaller limit because each layer needs its own review. Timing varies, and Morrow cannot promise a date. Missing paperwork causes many delays, so have your contract requirement, current policy, loss runs and accreditation details ready. Send those to Morrow and we will review them and request quotes.
Looking for $5M in Professional Liability? Morrow can help.
Send us the insurance requirement from your contract and your current policy. Morrow can review both and request quotes for a $5M primary policy or a primary plus excess layers.
