For testing laboratories with a client contract asking for $10M, this limit is very high and is usually built as a primary policy plus follow-form excess layers.
The short answer
- A $10M requirement is rare for testing laboratories, usually comes from a large manufacturer, energy owner, major project or government contract, and is usually met with several stacked policies, not one.
- It is usually built as a tower: a primary policy plus one or more follow-form excess layers.
- $10M is very rare online and almost always needs a broker to place each layer. Morrow can help you find it.
What does a $10M requirement mean for testing laboratories?
Professional Liability (E&O, short for Errors and Omissions) covers claims that your testing or report caused a client a financial loss. A $10M clause for a lab might read like this:
Illustrative contract wording
Laboratory shall maintain Professional Liability insurance covering all testing, analysis and reporting services, with limits of not less than $10,000,000 per claim and $10,000,000 annual aggregate. If claims-made, coverage shall be maintained for six (6) years after final delivery of results. Limits may be satisfied by a combination of primary and excess policies.
Illustrative example only. Your contract's wording controls.
- Per claim and aggregate: the most paid for one claim, and for all claims in one policy year. Both must reach $10M.
- Claims-made: Professional Liability almost always covers claims made and reported while the policy is active, for work done after the retroactive date (the earliest date of work the policy covers).
- Six years after results: a bad result may surface years later, so you would usually renew every layer with the same retroactive date, or buy an extended reporting period (time to report claims after a policy ends) if you stop renewing.
- Primary plus excess: if your clause is silent, confirm with the client that primary plus follow-form excess meets it.
Who asks testing laboratories for $10M?
Some lab contracts ask for $1M or $2M, and larger clients may ask for $3M or $5M. Compared with $5M, $10M usually needs more excess layers, each with its own underwriting review. $10M requests usually come from:
- Large manufacturers that release product based on your results. In a hypothetical case, a lab clears fasteners that later crack, and the maker claims recall costs.
- Energy and utility owners testing fuels, welds or emissions.
- Large construction programs. Picture a hypothetical lab whose concrete results were wrong, and the owner rebuilds a deck.
- Federal and state agencies, on very large programs.
How is $10M built?
Labs are sometimes placed on Miscellaneous Professional Liability, a form for service firms without their own policy type. Labs with licensed engineering services may use Architects and Engineers (A&E) Professional Liability instead.
A primary policy pays first. Each excess layer pays only after the layers below it are used up. "$5M xs $5M" means a $5M layer above the first $5M.
Example A: $5M primary
Example B: $2M primary
Each excess layer should follow form. That means it adopts the primary policy's terms, retroactive date and policy period. Many policies pay defense costs inside the limit, so legal fees can use up part of the $10M. A commercial umbrella almost never counts toward this limit.
If you carry less today, Morrow can request new quotes for excess layers or a higher primary, keeping your retroactive date and prior acts coverage (cover for past work) where the market allows.
Good to know
Only one contract needs $10M? A project-specific Professional Liability policy, where available, covers only that engagement. Morrow can help you find it.
What will underwriters ask for?
- Revenue by testing type: materials, environmental, product, forensic or field work.
- Accreditations such as ISO/IEC 17025 (the lab quality standard), the methods they cover, and recent proficiency testing (outside checks of your results) scores.
- Chain of custody (the record of who handled each sample), sample retention and calibration records.
- Whether you certify results as compliant or only report data, and who signs each report.
- Any testing you send to other labs, and whether you hold their insurance proof.
- The $10M contract, plus recent loss runs (a report listing past claims), often five years.
What affects the cost?
- What your results decide. Results used for product release, structural approval or a lawsuit usually cost more than routine data reporting.
- How the tower is built. The primary layer usually costs the most per $1M of limit. Higher excess layers usually cost less per $1M.
- Claims history and quality controls. Past claims or weak review steps can raise the price or cap the limit offered.
- Retention and defense terms. Retention works like a deductible.
Frequently asked questions
Do I need $10M Professional Liability as a testing laboratory?
Only if your contract or client asks for it. A $10M limit is uncommon for smaller labs and depends on revenue, the type of testing and the claims record. Morrow can help you find it.
Can my client be added as an additional insured on my $10M policy?
Usually not. Most Professional Liability policies do not let you add a client as an additional insured. In some cases a carrier may agree to name a client for liability that comes from your services, but this depends on the policy wording and underwriting. Confirm every excess layer follows form. A certificate of insurance (one-page proof of coverage) does not add anyone. It only shows your coverage.
Should I tell my current insurer about a possible problem with past results before I switch Professional Liability?
Yes. Report it to your current insurer before you switch. New policies usually exclude incidents you already knew about.
Is $5M enough if my contract says $10M?
No, not if the clause says $10M per claim and in the aggregate. A $5M primary alone falls short. Primary plus follow-form excess can reach $10M, so confirm with the client that the combined tower meets the clause. Morrow can help you find the layers.

Send us the insurance requirement from your contract and your current policy. Morrow can review both and request quotes for a primary and excess tower, or a project-specific policy.
