For safety consultants asked by a refinery, utility or major project owner for $5M, Professional Liability (E&O) usually means one $5M policy or a primary policy plus follow-form excess layers.
The short answer
- $5M Professional Liability (E&O) for a safety consultant usually means $5M per claim / $5M aggregate, met by one policy or by a primary policy plus follow-form excess layers.
- Safety contracts often ask for $1M or $2M. A $5M requirement may come from refineries, chemical plants, utilities and very large projects.
- $5M is very rare online and almost always requires a broker. Morrow can help you find it.
What does a $5M requirement mean for safety consultants?
Professional Liability (E&O, short for Errors and Omissions) covers claims that your advice, audits or plans caused a client a loss. A $5M clause may read like this:
Illustrative contract wording
Consultant shall maintain Professional Liability insurance covering process safety, auditing and on-site safety management services, with limits of not less than $5,000,000 per claim and $5,000,000 annual aggregate. If claims-made, coverage shall be maintained for five (5) years after completion. Limits may be satisfied by a combination of primary and excess policies.
Illustrative example only. Your contract's wording controls.
- Per claim and aggregate: the most paid for one claim, and for all claims in a policy year.
- Claims-made: Professional Liability almost always covers claims made and reported during the policy. The retroactive date is the earliest date of work the policy covers.
- Five years after the job: you would usually keep every layer in force with the same retroactive date, or buy an extended reporting period (extra time to report claims) if you stop renewing.
- Primary plus excess: excess layers that follow form use the same terms as the primary. If your clause is silent on stacking, confirm with the client that primary plus follow-form excess meets it.
Who asks safety consultants for $5M?
The client's worst case is huge, even if your fee is small:
- Refineries and chemical plants hiring you for process safety reviews (checks to prevent leaks and fires) or hazard analyses.
- Utilities and energy companies using you for contractor safety or arc flash programs (rules to prevent electrical burns and blasts).
- Owners and general contractors on major projects, where you serve as site safety manager.
- Large manufacturers that roll out your written programs at many plants.
- Government agencies, where the request for proposal (RFP) often sets the limit.
Picture a hypothetical claim: a hazard review misses a failure point, and a later fire shuts a plant unit for months. Defense costs alone could be large.
How is $5M built?
Safety consultants often buy Miscellaneous Professional Liability, a general form for service firms that do not fit a specialty policy. Licensed engineers usually need Architects and Engineers (A&E) Professional Liability instead.
A primary policy pays first. An excess policy pays only after the layer below is used up. "$3M xs $2M" means a $3M layer above the first $2M. Together, the stack of layers is called a tower.
Example A: single policy
Example B: two layers
Example C: three layers
A $3M clause often fits a primary policy or a small excess layer, and a $2M clause is often met by one primary policy. See $3M for safety consultants and $2M for safety consultants. At $5M, insurers often look harder at your sites' hazard level, and a primary plus excess stack is common.
Each excess layer should follow form, adopting the primary policy's terms. Match the retroactive date on every layer. A commercial umbrella almost never covers Professional Liability, so it cannot fill the tower.
Good to know
Watch the bodily injury wording. Many standard forms exclude or limit bodily injury and property damage. Safety firms often need a form that responds to injury arising from their services. Ask that every excess layer follow that wording, and know that the market may limit it. Defense costs often reduce the limit, so check this on every layer.
What will underwriters ask for?
An underwriter decides whether to offer coverage, and on what terms.
- Revenue split by service, such as process safety, audits, training and on-site safety management.
- The high-hazard sites you serve.
- Whether staff can stop work, sign off on permits or certify that a program meets a standard.
- The $5M contract and your client agreement.
- Five years of loss runs (carrier reports of past claims), known incidents, and your current policy.
What affects the cost?
- Hazard level of your clients. High-hazard process safety work usually costs more than training.
- How the tower is built. Primary layers usually cost the most per $1M, and higher excess layers less.
- Revenue and contract size. Larger contracts can mean bigger losses.
- Claims history. Past claims can shrink the limit offered or raise cost.
- Retention and defense terms. Retention works like a deductible.
Frequently asked questions
Do I need $5M Professional Liability as a safety consultant?
Only if your contract or client requires it. Check the insurance section of the contract or request for proposal. $5M is very rare online and almost always requires a broker. Morrow can help you find it.
Is $2M/$2M or $3M enough if my contract says $5M?
Not on its own. Confirm with the client whether primary plus follow-form excess meets the clause.
I carry $1M or $2M today. How do I reach $5M?
Request new quotes through Morrow for a new $5M primary or excess layers. We can ask to keep your retroactive date and prior acts coverage (coverage for work done before the new policy starts) where the market allows. Report known incidents to your current carrier before you switch.
Can a client be added as additional insured on my safety consulting policy?
Usually not on Professional Liability, and never automatically. Some policies may add a client for its liability arising from your services if requested, and this must apply to every layer. A certificate of insurance (a one-page proof of coverage) alone grants no coverage rights.
Looking for $5M in Professional Liability? Morrow can help.
Send us the contract requirement and your current policy. Morrow can review both and request quotes for a $5M primary policy or a primary plus excess layers, keeping your retroactive date where the market allows.
