$3M Professional Liability (E&O) Insurance for Safety Consultants

In this guide

For safety consultants whose contract asks for $3M: it usually means one $3M primary policy, or a smaller primary plus an excess layer, with $3M per claim and in total.

The short answer

  • A $3M Professional Liability (E&O) requirement means your safety firm needs $3M per claim and $3M total per policy year, usually as one primary policy or a primary plus excess.
  • That is above the $1M or $2M many safety contracts ask for. Confirm with the client that a $1M or $2M primary plus a follow-form excess layer meets the clause.
  • $3M for safety work is rarely available online and is usually placed by a broker. Morrow can help you find it.

What does a $3M requirement mean for safety consultants?

Professional Liability (E&O, short for Errors and Omissions) covers claims that your advice, written program, audit or training caused a client a loss. A $3M clause in a safety services contract might read like this:

Illustrative contract wording

Contractor shall maintain Professional Liability insurance covering safety consulting services, with limits of not less than $3,000,000 per claim and $3,000,000 annual aggregate. Limits may be met by a primary policy alone or in combination with excess policies. Coverage shall remain in force for three (3) years after completion of the Work.

Illustrative example only. Your contract's wording controls.

  • Per claim and aggregate: the most the policy pays for one claim, and for all claims in one policy year. Here, $3M each.
  • Stacking: the second sentence lets you combine a primary and an excess policy.
  • Claims-made: Professional Liability almost always pays only for claims made while the policy is active. The work must also be on or after the retroactive date (the earliest work date the policy covers). You may need every layer in force for those three years, or extended reporting coverage where offered.

Who asks safety consultants for $3M?

Many safety contracts start at $1M or $2M. The step to $3M may come with higher-hazard work, where one mistake could hurt many people. A $2M primary alone does not meet a $3M clause, but a $2M primary plus $1M follow-form excess can, if the clause allows stacking. Above $3M, see $5M for safety consultants.

$3M may come up with these buyers. Your contract sets the requirement.

  • Refineries, chemical plants and utilities hiring you for process safety reviews or hazard analyses.
  • Owners and general contractors who name you site safety manager with power to stop unsafe work.
  • Insurers and other large buyers that hire safety firms for loss control work may set their own limit.
  • Government agencies, which set the limit in the request for proposal.

Here is a hypothetical example, not a real event: a plant uses your written confined space entry program. One gas testing step is unclear, and two workers are hurt. The owner could claim your program caused the loss. Defense and settlement costs in a case like that are what a $3M limit is meant to help absorb.

How is $3M built for a safety consulting firm?

A primary policy pays first. An excess layer pays only after the primary limit is used up. "$1M xs $2M" means a $1M layer sitting above the first $2M.

Option 1: one policy

Primary policy$3M / $3M

Option 2: $2M primary plus excess

Excess layer$1M xs $2M
Primary policy$2M / $2M
Each block is a separate policy. Every option totals $3M per claim and $3M aggregate.

The excess should follow form, meaning it uses the primary policy's terms, with the same retroactive date and policy period. A commercial umbrella almost never covers Professional Liability, so it does not count toward the $3M.

Safety consultants often buy Miscellaneous Professional Liability, a general form for consulting firms. Those who are licensed engineers, or do engineering design work, often buy Architects and Engineers (A&E) Professional Liability instead.

Many Miscellaneous forms exclude or restrict bodily injury and property damage, yet safety claims are often bodily injury claims. Confirm that the primary and each excess layer respond to bodily injury arising from your professional safety services.

If you carry $1M or $2M today, Morrow can request new quotes for a $3M primary or for excess layers, keeping your retroactive date and prior acts coverage (cover for past work) where the market allows.

Good to know

Defense costs count. Many Professional Liability policies pay defense costs inside the limit, so a long lawsuit can shrink it.

What will underwriters ask safety consultants for?

An underwriter is the carrier reviewer who decides on coverage.

  • Your services by share of revenue: audits, written programs, training, on-site staffing or process safety.
  • Whether your people work on site, can stop unsafe work or sign off on permits or confined space entries.
  • The industries you serve, such as refining, chemical, utility and high-rise work.
  • Staff credentials and any compliance sign-offs.
  • The contract requiring $3M, including the indemnity section (who pays if something goes wrong).
  • Loss runs (a carrier report of past claims) for three to five years, known incidents and your current policy.

What affects the cost of $3M for safety consultants?

  • Type of work. On-site safety management at energy or chemical sites usually costs more than classroom training.
  • Structure. The primary layer usually costs the most. Excess is often cheaper per $1M of limit.
  • Claims history. Past claims can raise the price or limit what a carrier offers.
  • Retention and defense terms. Retention works like a deductible, and a higher one usually lowers premium. Defense outside the limit costs more.

Frequently asked questions

Do I need $3M Professional Liability as a safety consultant?

Only if your contract says so. Many safety contracts ask for $1M or $2M, while $3M may appear with refinery, chemical, utility and large construction work.

Can my client be added as an additional insured on my $3M Professional Liability?

Usually not. Professional Liability policies rarely let you add a client as an additional insured (someone else the policy protects). Clients more often get that status on your General Liability. A certificate of insurance (one-page proof of coverage) can list each Professional Liability layer. If your contract demands more, send it to Morrow with your policy.

What if a later contract asks safety consultants for $5M?

Another excess layer may be possible, but limits at that level are rarely found online and usually need a broker. Morrow can help you find them.
