For marketing consultants whose client contract asks for $3M: it means Professional Liability (E&O) with media liability, built as one $3M policy or a smaller primary plus follow-form excess.
The short answer
- A $3M requirement usually means a $3M Professional Liability (E&O) limit per claim and per policy year, with media liability, often set by large brands or big media budgets.
- You can meet it with one $3M primary policy, or a smaller primary plus a follow-form excess layer (extra coverage above the primary, on the same terms).
- $3M is rarely available online and is usually placed by a broker. Morrow can help you find it.
What does a $3M requirement mean for marketing consultants?
Professional Liability (E&O, short for Errors and Omissions) covers claims that your advice or services caused a client a financial loss. For marketing work, it should include media liability, which covers claims over copyright, trademark, defamation or privacy in your content. A $3M clause might read:
Illustrative contract wording
Consultant shall maintain Professional Liability insurance, including media liability for infringement and defamation, with limits of not less than $3,000,000 each claim and $3,000,000 in the aggregate. Coverage shall be maintained for two (2) years after this Agreement ends.
Illustrative example only. Your contract's wording controls.
- Each claim and aggregate: the most paid for one claim, and for all claims in a policy year. See how limits are written.
- Claims-made: Professional Liability is almost always claims-made. It covers claims made while the policy is active, for work on or after the retroactive date (the earliest date of work covered).
- Media wording: since this example clause names infringement and defamation, each layer should include media liability. Check your own contract's wording.
- Stacking: the clause does not say if primary plus excess counts. Confirm with the client that primary plus follow-form excess meets the clause.
Who asks marketing consultants for $3M?
A $3M request usually comes from:
- National brands hiring you for a launch, rebrand or naming project.
- Health, finance and insurance companies, where ad claims and privacy rules get close review.
- Public agencies running large outreach campaigns, with the limit often set in the request for proposal.
- Brand legal or procurement teams that set one limit for every agency and freelancer, even on a small project.
How is $3M built?
A primary policy pays first. An excess policy pays only after the primary limit is used up. "$2M xs $1M" means $2M above the first $1M.
Three ways to reach $3M: one $3M primary, $2M primary with $1M excess, or $1M primary with $2M excess.
Example A
Example B
Example C
The excess should follow form, meaning it uses the primary policy's terms, including media liability. Every layer should share the same retroactive date and named insured (the business the policy covers). If you also build websites or apps, Technology E&O may fit better (see $3M for technology and media firms). A commercial umbrella almost never covers Professional Liability, so it cannot fill the gap.
Compared with $2M, a $3M limit usually means more underwriting questions and often a broker. Morrow can help you find it. A $2M primary plus a $1M excess layer is one way to reach $3M. See the $2M guide.
Good to know
Hypothetical claims, for illustration only. A tagline you wrote is close to a rival's trademark, and the client must pull its ads. A media plan runs with wrong targeting for a month, and the client says its budget was wasted. Many policies in this class pay defense costs inside the limit, so legal fees can use up part of the $3M (see defense costs inside or outside the limit).
What will underwriters ask for?
An underwriter decides whether to offer coverage and on what terms. Expect questions on:
- Revenue split across strategy, branding, paid media, social, SEO, email and influencer work.
- Client ad spend you plan or control, and your largest client budget.
- Industries you serve, noting health, finance, alcohol, cannabis or other regulated work.
- How you clear images, music, names and taglines, and whether clients approve final content in writing.
- The contract requiring $3M, prior claims or demand letters, and your current policy and retroactive date.
What affects the cost?
- Type of work. Naming, ad creative and media buying usually carry more risk than strategy.
- Industries and clients. Regulated industries and national brands often mean bigger losses.
- How the $3M is built. The primary layer usually costs the most per $1M. Excess is often priced lower.
- Claims history. Past claims or cease-and-desist letters can raise the price or narrow options.
- Retention and defense terms. Retention is what you pay per claim before the policy pays, like a deductible. A higher one usually lowers premium.
Frequently asked questions
Can I get $3M Professional Liability as a solo marketing consultant?
Sometimes. It depends on revenue, client size and claims history. $1M to $2M is often easier to place, and $3M may need an excess layer over a smaller primary. $3M usually needs a broker. Morrow can help you find it.
Does General Liability cover an infringement claim over a campaign I made as a marketing consultant?
Often not, but it depends on the wording. Many General Liability policies exclude advertising injury for firms that create ads. Those claims belong on Professional Liability with media liability.
I have $1M Professional Liability as a marketing consultant. How do I get $3M?
Request new quotes through Morrow, either for a $3M primary or for excess layers above a new primary. Morrow can request both and ask to keep your retroactive date where the market allows. Report any possible claim to your current carrier before you switch.
Can my client be added as an additional insured on my $3M Professional Liability policy?
Usually not. An additional insured is someone else covered under your policy. Some policies may add a client in limited cases, but most do not. A certificate of insurance only shows your coverage and adds no one.
