$5M Professional Liability (E&O) Insurance for ERP and CRM Implementation Consultants

In this guide

For ERP and CRM implementation consultants facing a $5M client requirement: it usually means a policy, or stacked policies, that pay up to $5M for one claim.

The short answer

  • $5M Professional Liability (E&O) pays up to $5M for one claim that a mistake in your ERP or CRM work cost a client money.
  • It is often possible but on the high end. It is usually a $1M or $2M primary policy plus follow-form excess layers, or one $5M primary policy when an insurer offers it.
  • $5M is very rare online and almost always requires a broker and a full submission. Morrow can help you find it.

What does a $5M requirement mean for ERP and CRM implementation consultants?

Professional Liability (E&O, short for Errors and Omissions) covers claims that a mistake in your services cost a client money. ERP and CRM firms usually buy it as Technology E&O (coverage for mistakes in tech services), often combined with Cyber (coverage for data breaches and network security failures), rather than Miscellaneous E&O. A $5M clause in an enterprise MSA (master services agreement) may read like this:

Illustrative contract wording

Supplier shall maintain Technology Errors and Omissions insurance covering implementation and data migration services, with limits of not less than $5,000,000 per claim and $5,000,000 annual aggregate, and Network Security and Privacy Liability insurance of not less than $5,000,000. Limits may be met by primary and excess policies. Claims-made coverage shall be maintained for three (3) years after final acceptance.

Illustrative example only. Actual contract wording varies.

  • Per claim and aggregate: the most paid for one claim, and for all claims in a policy year.
  • Two coverages: $5M of Technology E&O and $5M of Cyber. Check whether a shared limit meets the clause. See Professional Liability vs Cyber.
  • Stacking: this clause allows primary plus excess. If yours is silent, confirm with the client that primary plus follow-form excess meets the clause.
  • After final acceptance: Professional Liability is almost always claims-made, meaning it covers claims first made while the policy is active. With a clause like this one, you may need to keep every layer for three years with the same retroactive date (the earliest date of work covered).

Who asks ERP and CRM implementation consultants for $5M?

A $5M request often comes from:

  • Large enterprises replacing a core ERP.
  • Large integrators passing their $5M terms to you as a subcontractor.
  • Banks, insurers and payment firms moving customer records or billing.
  • Health systems and plans putting patient or member data in a CRM.
  • Public agencies setting the limit in an RFP (a formal request for bids).

How is $5M built?

A primary policy pays first. An excess policy pays only after the layers below it are used up. "$3M xs $2M" means a $3M layer above $2M.

Example A: single policy

Primary policy$5M / $5M
Total: $5M per claim / $5M aggregate

Example B: two layers

Excess layer$3M xs $2M
Primary policy$2M / $2M
Total: $5M per claim / $5M aggregate

Compared with $3M, $5M often means one more layer or a larger primary limit. Each added layer is another policy to keep in step. Compared with $10M, $5M usually needs fewer layers.

Each excess layer should follow form, meaning it uses the primary policy's terms. If your primary combines Technology E&O and Cyber, check that the excess sits over both. Many policies pay defense costs inside the limit, so legal bills reduce what is left. A commercial umbrella almost never adds to Professional Liability.

What will underwriters ask for?

An underwriter decides whether to offer coverage and on what terms.

  • Platforms you implement, and revenue split across configuration, custom code, integrations and data migration.
  • Your largest rollouts: contract values, users, and prime or subcontractor role.
  • How you run cutover: mock conversions, data checks, go/no-go sign-off and a rollback plan.
  • Whether each statement of work sets scope, acceptance criteria and change orders.
  • Your access to client systems and personal data, and your security controls.
  • The contract clause that asks for $5M, plus your current policy, retroactive date and loss runs (a report of past claims).

What affects the cost?

  • How critical the system is. Finance, billing and supply chain go-lives usually cost more than sales CRM setups.
  • Project size and role. A multi-country rollout as prime usually costs more than one module under an integrator.
  • How the layers are built. Higher excess layers are often priced lower per $1M, but it varies.
  • Controls and claims history. Past claims can raise the price or shrink the limit.
  • Retention and Cyber. A retention works like a deductible. A higher one usually lowers premium. Matching Cyber limits usually add cost.

Frequently asked questions

Do I need $5M Professional Liability as an ERP or CRM consultant?

Only if your contract or RFP requires it. A large claim could start with a failed go-live. Hypothetical example: a CRM integration sends duplicate charges to bank customers.

I have $1M or $2M of Professional Liability. How do I get to $5M?

Request new quotes: a new primary at a higher limit, or follow-form excess layers above your primary. Morrow can request both, keeping your retroactive date and prior acts coverage (coverage for work done before the new policy starts) where the market allows. Report known incidents to your current carrier before you switch.

Can my client be added as an additional insured on my Professional Liability?

Usually not, and it is not automatic. Some Technology E&O insurers may add a client as additional insured when a written contract requires it, usually only for liability arising from your services. Each excess layer must follow form for that to extend upward. Some clients accept a certificate of insurance (a one-page summary of your policies; it does not change the policy) listing each layer and its limit, while others ask for more.

Can a small ERP or CRM consulting firm get $5M Professional Liability?

It may be possible, but it is not typical for small firms. Insurers look at revenue, largest project size, controls and claims history, and may cap the limit. $5M almost always requires a broker. Morrow can help you find it.

Looking for $5M in Professional Liability? Morrow can help.

Send Morrow the insurance requirement from your contract and your current policy. Morrow can review both and request quotes for $5M in Technology E&O, with Cyber if the contract calls for it.
