$10M Professional Liability (E&O) Insurance for ERP and CRM Implementation Consultants

In this guide

ERP and CRM implementation consultants asked for $10M before a major go-live usually build it as a primary Professional Liability (E&O) policy plus follow-form excess layers.

The short answer

  • $10M in Professional Liability (E&O) is a high limit. ERP and CRM firms usually reach it with a primary policy plus follow-form excess layers.
  • A tower stacks a primary policy and excess layers to reach $10M per claim / $10M aggregate.
  • $10M is very rare online and almost always requires a broker. Morrow can help you find it.

What does a $10M requirement mean for ERP and CRM implementation consultants?

Professional Liability (E&O, short for Errors and Omissions) covers claims that your mistake cost a client money. ERP and CRM firms usually buy it as Technology E&O, often sold with Cyber (coverage for data breaches and system attacks), rather than Miscellaneous E&O. A $10M clause in a master services agreement (MSA) may read like this:

Illustrative contract wording

Supplier shall maintain Technology Errors and Omissions insurance covering implementation, integration and data conversion services, and Network Security and Privacy Liability insurance, each with limits of not less than $10,000,000 per claim and in the aggregate. Limits may be met by primary and excess policies. Claims-made coverage shall be maintained for five (5) years after final acceptance.

Illustrative example only. Actual contract wording varies.

  • Per claim and aggregate: the most paid for one claim, and for all claims in a year.
  • Two coverages: Technology E&O and Cyber, each at $10M. Cyber is a separate coverage with its own limit. See Professional Liability vs Cyber.
  • Five years after acceptance: the policy is claims-made, which covers claims made while the policy is active. Each layer may need to be renewed with the same retroactive date (the earliest date of work covered).
  • Stacking: this clause allows primary plus excess. If your clause is silent, confirm with the client that primary plus follow-form excess meets it.

Who asks ERP and CRM implementation consultants for $10M?

Many firms are asked for $1M to $3M, and some for $5M. $10M shows up when one failed go-live could stop a very large business:

  • Global enterprises replacing finance or supply chain systems.
  • Large integrators passing $10M terms to subcontractors.
  • Banks, insurers and payment firms moving billing or customer records.
  • Health systems and plans linking a CRM to patient data.
  • State agencies setting limits in a request for proposal (RFP).

How is $10M built?

A primary policy pays first. Each excess layer pays once the layers below are used up. "$5M xs $5M" means $5M above the first $5M. Compared with $5M, a $10M tower often has more layers, so there are more policies to place and renew.

Example A: three layers

Second excess$5M xs $5M
First excess$3M xs $2M
Primary Technology E&O$2M / $2M
Total: $10M per claim / $10M aggregate

Example B: four layers

Third excess$5M xs $5M
Second excess$2M xs $3M
First excess$2M xs $1M
Primary Technology E&O$1M / $1M
Total: $10M per claim / $10M aggregate
Each block is a separate policy.

Each excess layer should follow form, meaning it uses the primary policy's terms. Every layer should share the same retroactive date and policy period. Many policies pay defense costs inside the limit, so legal bills shrink what is left. A commercial umbrella almost never adds to Professional Liability.

Good to know

Only one program needs $10M? Ask about a project-specific policy. Where available, it is written for that engagement only, so a claim there may not use up your firm-wide limit. This depends on the policy wording. It almost always requires a broker. Morrow can help you find them.

What will underwriters ask for?

Underwriters may ask for:

  • Platforms you implement, and your revenue split across configuration, code, integrations and data migration.
  • The $10M program: contract value, users, countries, and your role.
  • How you run cutover: mock conversions, data checks, go/no-go sign-off and a tested rollback plan.
  • Your access to production systems and personal data.
  • The MSA, any limitation of liability clause (a cap on what you owe a client), loss runs (a report of past claims) and your policy.

What affects the cost?

  • How critical the system is. Finance and billing go-lives usually cost more than sales CRM work.
  • Your role and program size. Running a multi-country rollout usually costs more than doing one workstream under an integrator.
  • How the tower is built. The primary layer usually costs the most per $1M of limit.
  • Controls and claims history. Tested cutovers often help. Past claims can raise the price or shrink the limit.
  • Retention. A retention works like a deductible; a higher one usually lowers premium.

Frequently asked questions

What could a $10M claim look like for an ERP or CRM consultant?

It usually starts with a failed go-live that harms the client's operations. Hypothetical examples: a new ERP cannot plan production, and plants slow down for a month. A conversion error corrupts open invoices, and the client cannot bill for weeks.

I have $2M Professional Liability as an ERP consultant. How do I get to $10M?

Request new quotes for excess layers above your current primary, or a new primary with excess. Morrow can request both and ask carriers to keep your retroactive date and prior acts coverage (cover for past work) where the market allows. Report any known incidents to your current carrier before you switch.

Can my client be added as an additional insured on my Professional Liability?

Usually not. Some policies may allow it in limited cases, for liability that comes from your work only. This depends on the policy wording, and each excess layer would need to follow form. Many clients accept a certificate of insurance (a one-page proof of coverage) listing each layer. It does not change the policy.

Can a small implementation firm get $10M?

In some cases, yes, depending on underwriting. Underwriters weigh your revenue, the size of the engagement and your claims history, so a small firm may be offered less than $10M. A $10M limit almost always requires a broker. Morrow can help you find it.

Looking for $10M in Professional Liability? Morrow can help.

Send us the contract requirement and your current policy. Morrow can review both and request quotes for a $10M Technology E&O tower, or a project-specific policy where available, plus Cyber if the contract asks for it.
