Why does general liability cost so much in New York?

General liability pays if your work injures someone or damages property that is not yours. In New York the biggest claims come from one source. The state has a law that makes owners and general contractors fully responsible when a worker falls or is hit by a falling object, even if the worker was careless. It is called the Scaffold Law (Labor Law 240). The injured worker sues the owner and the general contractor, who pass the claim down to the sub whose worker fell. That is why some insurers will not write New York construction at all and the rest charge more.

How much general liability does New York actually require?

New York has no statewide contractor license and no statewide general liability rule. Local licensing sets the floor and your contracts set the ceiling. A registered general contractor in New York City must carry at least $1,000,000 per occurrence, which means for any one incident, from an insurer with a strong financial strength rating (A- or better on the scale contracts name), and must list the NYC Department of Buildings as certificate holder. Nassau County's home improvement license asks for $250,000 per person, $500,000 per accident, and $100,000 property damage. Suffolk County may require $500,000.
