Why do my Florida workers comp quotes all look the same?
Because Florida is a rate state: NCCI files one set of rates, the Office of Insurance Regulation approves them, and insurers use them with limited deviation. The direction is good news. What if insurers keep turning me down?
Florida has no state fund. It has a pool of last resort for employers nobody else will take, run under state law (F.S. 627.311) and called the FWCJUA. To get in you must show that two insurers rejected you. The pool loads its premiums above the open market by tier, plus a flat $475 fee. It is small and shrinking, which tells you most Florida employers find a home in the regular market.
Two declinations are not the end. A broker can send your application to insurers you cannot reach yourself, including specialty markets, and can ask a declining insurer what it wants to see next year. Some contractors also look at a professional employer organization, which leases your employees back to you under its own policy.
One catch. Under a professional employer organization the workers comp policy belongs to it, not you, so your general contractor's certificate comes from the organization, any waiver is requested through it, and anyone you pay outside its payroll is not covered.
What paperwork gets me the best Florida quote?
- Payroll by employee and job category, with job descriptions for anyone you want rated clerical.
- Five years of loss runs, your claims history report, and your current experience modification worksheet.
- Certificates of Election to be Exempt for any owners coming off the policy.
- Certificates of insurance or exemption from every sub. If one turns up uninsured, two things set the bill: the payroll belongs in that sub's own trade category, not yours, and if you cannot show what the sub paid its workers the insurer charges a percentage of the contract price instead, which is usually higher (F.S. 440.10).
- A one page safety program. It answers the first question every underwriter asks.
- Hourly wage records for July through September of last year, for the wage credit.

The setup: A concrete contractor in Ocala with six employees let his workers comp lapse for two months after a dispute with his agent. Two insurers declined the renewal over the gap and a $40,000 claim two years earlier. He landed in the state's pool of last resort at an illustrative $31,000, including the surcharge and the $475 fee.
What went wrong: He assumed the pool was the only option and stayed two years. Nobody reviewed his categories, applied for the wage credit, or asked the declining insurers what they needed to see.
What it cost: A broker applied to five open market insurers with a clean year of loss runs, a one page safety program, and corrected categories. The best quote was an illustrative $23,500, about $7,500 less, with the wage credit still to come.
