$3M Professional Liability (E&O) Insurance for Telecom Consultants

In this guide

If a large client requires $3M in Professional Liability from your telecom consulting firm, you can usually meet it with one $3M primary policy or a smaller primary plus follow-form excess.

The short answer

  • Telecom consultants can usually meet a $3M requirement with one $3M primary policy (the policy that pays first), or a $1M or $2M primary plus a follow-form excess layer (extra limit that uses the same terms).
  • $3M is on the high end for telecom consultants. It often comes from enterprise MSAs (master service agreements), often alongside a Cyber limit (Cyber covers data breaches and network attacks). Confirm with the client that primary plus excess meets the clause.
  • $3M is rarely available online and is usually placed by a broker. Morrow can help you find it.

What does a $3M requirement mean for telecom consultants?

Professional Liability (E&O, short for Errors and Omissions) covers claims that a mistake in your advice or services cost a client money. The form depends on the work. Network design and cutovers (the day a client switches to a new phone or network system) usually point to Technology E&O, often with Cyber. Advisory, bill-audit and vendor-selection work is often written on Miscellaneous or Consultants Professional Liability. A $3M clause might read like this:

Illustrative contract wording

Consultant shall maintain Technology Errors and Omissions insurance, including network security and privacy liability, with limits of not less than $3,000,000 per claim and $3,000,000 annual aggregate. If written on a claims-made basis, the retroactive date shall be no later than the effective date of this Agreement, and coverage shall be maintained for three (3) years after completion of the Services.

Illustrative example only. Your contract's wording controls.

  • Per claim and aggregate: the most the policy pays for one claim, and for all claims in a policy year.
  • Claims-made: Professional Liability is almost always claims-made. It covers claims made and reported while the policy is active, for work done on or after the retroactive date (the earliest work date covered).
  • After the work ends: you would usually renew every layer, with the same retroactive date, for three years.
  • Layers: this sample does not say whether primary plus follow-form excess meets the clause. Confirm with the client in writing.

Who asks telecom consultants for $3M?

Many telecom consultants are asked for $1M or $2M. $3M shows up when one mistake could hit many sites or users at once, and a $2M clause may move up to $3M in large enterprise and public safety work:

  • Large enterprises whose MSAs set higher Technology E&O and Cyber limits for all vendors.
  • Phone, cable and fiber providers hiring help with builds.
  • Hospital systems moving clinical phones.
  • Public agencies running large network or 911 upgrades through an RFP (request for proposal).
  • Prime contractors that pass their client's limits to you.

How is $3M built?

A primary policy pays first. An excess policy pays only after the primary limit is used up. "$2M xs $1M" means a $2M layer above the first $1M.

Example A: one policy

Primary policy$3M / $3M
Total: $3M per claim and aggregate

Example B: two layers

Excess layer$1M xs $2M
Primary policy$2M / $2M
Total: $3M per claim and aggregate

Example C: two layers

Excess layer$2M xs $1M
Primary policy$1M / $1M
Total: $3M per claim and aggregate

The excess should follow form, meaning it uses the same terms as the primary policy. If your primary combines Technology E&O and Cyber, check that the excess sits over both. See Professional Liability vs Cyber.

Good to know

Defense costs can use up the limit. Many Professional Liability policies pay defense costs inside the limit. A long dispute over a failed cutover can shrink what is left to settle. See defense inside or outside the limit.

What will underwriters ask for?

An underwriter decides whether to offer coverage and on what terms. Expect questions on:

  • Your mix of services: network design, carrier contract advice, bill audits or hands-on cutovers.
  • Whether you touch 911, hospital paging or other life-safety systems.
  • Whether you log in to client systems, and how you secure access.
  • The $3M contract, your largest projects and any subcontractors.
  • Your client agreement, including any limitation of liability clause (a cap on what you owe a client), and any carrier commissions you receive.
  • Loss runs (a report of past claims), anything that could become a claim, and your current retroactive date.

What affects the cost?

  • Type of work. Hands-on cutovers and life-safety work usually cost more than advice.
  • Revenue and project size. Hospital and public safety clients raise stakes.
  • How the $3M is built. The primary layer often costs the most per $1M of limit. Excess layers are often priced lower per $1M, but this varies.
  • Cyber. Adding Cyber adds cost.
  • Retention and claims history. Retention works like a deductible. A higher one usually lowers premium.

Frequently asked questions

Do I need $3M Professional Liability as a telecom consultant?

You need it only if a contract or client requires it. Check the insurance clause, and confirm with the client whether primary plus follow-form excess meets it.

What kind of claim could reach $3M for a telecom consultant?

A claim over a failed multi-site cutover could. Here is a hypothetical example: you design a phone migration for a 40-site hospital network, a routing setting is missed, and calls to several sites fail for a day. The client sues for lost revenue and repair costs. Many sites, a long outage and legal defense costs can push a claim toward $3M.

Can I use my commercial umbrella to reach $3M?

Almost never. A commercial umbrella (extra liability coverage over your general liability policy) usually excludes professional services. You usually need a higher primary limit or a follow-form excess Professional Liability policy.

I already carry $1M or $2M Professional Liability. How do I get to $3M?

Request new quotes, either a new $3M primary or a follow-form excess layer over your current policy. Morrow can request quotes that keep your retroactive date and prior acts coverage (cover for work done before the new policy starts) where the market allows. Keep the current policy in force until new coverage is in place. Report anything that could become a claim to your current carrier before any change.

Looking for $3M in Professional Liability? Morrow can help.

Send us the insurance requirement from your contract and your current policy. Morrow can review both and request quotes for a $3M primary policy or a primary plus excess, keeping your retroactive date where the market allows.
