$3M Professional Liability (E&O) Insurance for Supply Chain Consultants

In this guide

For supply chain consultants whose client contract asks for $3M in Professional Liability: it usually means $3M per claim and in total, built as one policy or primary plus follow-form excess.

The short answer

  • A $3M requirement means your Professional Liability (E&O) pays up to $3M per claim and $3M in total for the policy year, built as one policy or a primary plus follow-form excess.
  • It is on the high end for supply chain consultants and usually comes from very large clients. Confirm with the client that primary plus follow-form excess meets the clause.
  • $3M is rarely available online and is usually placed by a broker. Morrow can help you find it.

What does a $3M requirement mean for supply chain consultants?

Professional Liability (E&O, short for Errors and Omissions) covers claims that your advice cost a client money, such as a faulty forecast or supplier review. A $3M clause may read:

Illustrative contract wording

Consultant shall maintain Professional Liability (Errors and Omissions) insurance covering the sourcing, procurement, supplier risk and supply chain planning services under this Agreement, with limits of not less than $3,000,000 each claim and $3,000,000 annual aggregate. Limits may be satisfied by a combination of primary and excess policies. If written on a claims-made basis, coverage shall be maintained for three (3) years after completion of the services.

Illustrative example only. Your contract's wording controls.

  • Per claim and aggregate: the most paid for one claim, and for all claims in the policy year. Here, both are $3M.
  • Claims-made: Professional Liability almost always covers claims made and reported while the policy is active, for work done after the retroactive date (the earliest work date covered).
  • Primary and excess: this clause allows stacked policies. If yours is silent, ask the client whether stacked policies count.

Who asks supply chain consultants for $3M?

Many contracts ask for $1M or $2M. A $3M clause is a step above those. It usually follows large client spend or a regulated product, and often needs a primary plus excess build. It tends to come from:

  • Fortune 500 manufacturers whose MSA (master services agreement) sets one limit for all advisors.
  • Pharma, device and food companies qualifying suppliers.
  • Aerospace and defense firms buying supplier risk work.
  • Health systems cutting supply costs.
  • Government agencies buying procurement studies, often with the limit in the RFP (request for proposal).
  • Private equity firms relying on your review.

How is $3M Professional Liability built?

A primary policy pays first. An excess policy pays only after the primary limit is used. "$2M xs $1M" means a $2M layer above the first $1M.

Example A: single policy

Primary policy$3M / $3M
Total: $3M

Example B: two layers

Excess layer$1M xs $2M
Primary policy$2M / $2M
Total: $3M

Example C: two layers

Excess layer$2M xs $1M
Primary policy$1M / $1M
Total: $3M
Each example adds up to $3M per claim and $3M aggregate.

The excess should follow form, meaning it adopts the primary policy's terms. Every layer should share the same retroactive date, policy period and named insured (the policyholder). Many Professional Liability policies pay defense costs inside the limit.

Many supply chain consultants buy Miscellaneous Professional Liability, a form made for advice-based firms. If you build or configure planning software, Technology E&O (a form made for software and tech services) may fit better.

If you carry $1M or $2M today, request new quotes through Morrow for a $3M primary or an excess layer. Morrow can request quotes that keep your retroactive date and prior acts coverage (cover for work done before the new policy starts) where the market allows. These structures are rarely found online. Morrow can help you find them.

What will underwriters ask supply chain consultants for?

An underwriter decides whether to offer coverage and on what terms. Underwriters may review:

  • Your services, such as sourcing or demand planning, with revenue from each.
  • Whether you sign supplier contracts or manage client spend, or only advise.
  • Whether you approve suppliers for quality or give tariff advice.
  • Whether you promise savings or tie fees to them.
  • The $3M contract, the client spend in scope, and any limitation of liability clause (a cap on what you owe a client).
  • Loss runs (a report of past claims) and your current retroactive date.

What affects the cost of $3M Professional Liability?

  • Type of work. Supplier approval, trade advice and savings-based fees may cost more to insure than advisory studies.
  • Spend in scope. More client spend means a bigger possible loss.
  • How the $3M is built. The primary layer usually costs the most per $1M of limit.
  • Claims history. Past claims can raise the price.
  • Retention and defense terms. Retention is like a deductible.

Frequently asked questions

What kind of claim could lead a client to ask supply chain consultants for $3M?

Usually a costly error in advice. These examples are hypothetical. A supplier you qualified ships parts that fail inspection, and a device maker's production stops. A nearshoring study omits duty changes, and a plant moves on bad numbers.

Can a small supply chain consulting firm get $3M Professional Liability?

Sometimes, but it depends on revenue, services, claims history and contract size. Smaller firms may be offered less. A $3M primary, or a primary plus excess layer, may need a broker-placed market. Morrow can help you find it.

Does my umbrella policy cover $3M Professional Liability for a supply chain consultant?

Usually not. A commercial umbrella almost never covers Professional Liability (see umbrellas and Professional Liability). Clients usually cannot be added as an additional insured either (an outside party added to your policy and treated as covered). Some clients accept a certificate of insurance (a one-page proof of your coverage) listing every layer, but your contract controls.

Is $3M enough if my contract says $5M?

No, a $5M clause needs a $5M limit. That limit is very rare online and almost always needs a broker. Morrow can help you find it. See $5M Professional Liability for supply chain consultants.
