A $5M Professional Liability (E&O) requirement for property managers, inspectors and real estate service firms is often met by a smaller primary policy plus follow-form excess layers, and sometimes by one $5M primary.
The short answer
- $5M is often reached with a smaller primary policy plus follow-form excess layers, and sometimes with one $5M primary.
- An excess layer pays after the layer below it is used up. It should follow form, meaning it uses the primary policy's terms.
- $5M is very rare online and almost always requires a broker. Morrow can help you find it.
What does a $5M requirement mean for property managers and inspectors?
Professional Liability (E&O, short for Errors and Omissions) covers claims that a mistake in your work cost a client money. A $5M clause might read:
Illustrative contract wording
Manager shall maintain Professional Liability (Errors and Omissions) insurance of not less than $5,000,000 per claim and $5,000,000 annual aggregate. If written on a claims-made basis, the retroactive date shall be no later than the start of services, and coverage shall continue for three (3) years after termination. Limits may be satisfied by primary and excess policies.
Illustrative example only. Your contract's wording controls.
- Per claim and aggregate: the most paid for one claim, and for all claims in the policy year.
- Claims-made: Professional Liability almost always covers claims made while the policy is active. The retroactive date is the earliest work date the policy covers. Mistakes made before it are not covered.
- After the contract ends: you would usually renew every layer for the years required, or buy a tail (extended reporting period) where offered.
- Primary plus excess: this clause allows layers. If yours does not, confirm with the client that primary plus follow-form excess meets it.
Who asks property managers and inspectors for $5M?
$5M tends to come from clients with a lot riding on your work:
- REITs (real estate investment trusts) and institutional owners handing a manager a large portfolio of office or apartment buildings.
- Lenders and investment buyers relying on a property condition report or environmental review for a large loan.
- Developers hiring a construction manager or owner's representative (someone who guards the owner's interests) on big projects.
- Large public agencies that sometimes write $5M or more into bid documents for major projects.
At $2M, one primary policy is usually enough. At $5M, an excess layer is common, and at $10M several layers may be needed. See $2M, $3M or $10M for real estate service firms.
How is $5M in Professional Liability built?
A primary policy pays first. "$3M xs $2M" means a $3M excess layer above the first $2M. Stacked together, the layers form a tower.
Example A: one policy
Example B: two layers
Example C: three layers
A single $5M primary may be easier to find for larger property managers and larger commercial or environmental firms. Smaller firms, especially residential inspectors, usually need excess, and some may not get $5M at all.
Layers at this level often come from specialty markets that write higher limits, and they are rarely found online. Morrow can help you find them. Each excess layer should follow form. Every layer should share the same retroactive date, policy period and named insured (the business covered).
The right form depends on your work. Property managers and residential inspectors often buy real estate or inspector E&O, or a Miscellaneous Professional Liability form (a general form for service businesses). Commercial and property condition inspectors and construction managers often buy A&E (architects and engineers) or construction management professional liability. Environmental consultants and Phase I firms often buy environmental consultants professional liability, which may include pollution coverage.
Good to know
Defense costs can use up the limit. Many Professional Liability policies pay defense costs inside the limit.
What will underwriters ask for?
- Each service you offer, and its share of revenue.
- Units, square feet or project value managed, or inspections each year.
- Whether you handle rent, deposits or project funds.
- The contract requiring $5M.
- Three to five years of loss runs (a report of past claims), plus your current policy and retroactive date.
What affects the cost?
- Type of work. Environmental, construction management and design-heavy work on high-value projects carries more exposure and may cost more to insure.
- Size of what you touch. Larger portfolios, loans and projects mean bigger losses.
- Claims history. Past claims can raise the price or lower the limit offered.
- Retention and defense terms. Retention works like a deductible. A higher one usually lowers premium.
Frequently asked questions
Can a small property management or inspection firm get $5M?
Sometimes. A small property manager may reach $5M with a primary plus excess. A small inspection firm may find it harder, and in some cases $5M is not available. It usually needs a broker. Morrow can help you find it.
I already have $1M or $2M. How do I get to $5M?
Request new quotes through Morrow, for a new primary at a higher limit or for excess layers. Morrow can ask carriers to keep your retroactive date and prior acts coverage (cover for past work) where the market allows. Report known incidents to your current carrier before you switch.
Can I use my commercial umbrella to reach $5M?
Almost never. A commercial umbrella usually excludes professional services. You usually need a higher primary limit or follow-form excess. Read more on umbrellas.
Can the owner or lender be added as an additional insured?
Usually not by default. Some property management forms and A&E forms let an owner or client be added, often only for vicarious liability (responsibility for your wrongful acts). Availability varies by carrier, and it is more limited on many inspector forms. If your client needs it, ask Morrow to check whether the excess layers follow the primary on this point. A certificate of insurance (a one-page summary of your coverage) can list every layer. Confirm what your client will accept.
