Loss control consultants asked for $3M in Professional Liability can often meet it with one $3M policy, or with a $1M or $2M primary policy plus excess coverage, if the contract allows.
The short answer
- $3M means your Professional Liability must pay up to $3M per claim and in total for the policy year, through one policy or primary plus excess if the contract allows.
- Contract limits vary a lot. $3M may come with larger clients or high-hazard sites.
- $3M is rarely available online and is usually placed by a broker. Morrow can help you find it.
What does a $3M requirement mean for loss control consultants?
Professional Liability (E&O, short for Errors and Omissions) covers claims that a mistake in your professional work caused someone a loss. For you, that work is a site survey, a risk report or a set of safety recommendations. A $3M clause might read:
Illustrative contract wording
Consultant shall maintain Professional Liability insurance covering loss control, risk assessment and safety consulting services with limits of not less than $3,000,000 per claim and $3,000,000 in the aggregate. Limits may be satisfied by a combination of primary and excess policies. If written on a claims-made basis, coverage shall be maintained for three (3) years after completion of services.
Illustrative example only. Your contract's wording controls.
- Per claim and aggregate: the most paid for one claim, and for all claims in a policy year.
- Claims-made: the policy covers claims made and reported while it is active, for work done after the retroactive date (the earliest date of work it covers).
- Primary plus excess: this clause allows several policies to add up to the limit. If yours is silent, confirm with the client that primary plus follow-form excess (excess that uses the primary policy's terms) meets the clause.
- Three years after: keep renewing every layer with the same retroactive date, or buy tail coverage (extra time to report claims after a policy ends).
Who asks loss control consultants for $3M?
The limit often tracks the client's exposure more than your firm's size. Examples:
- Large insurers and national programs that send you to many sites.
- Energy, chemical and utility companies hiring process safety or fire protection reviews.
- General contractors and owners on large projects hiring site safety audits.
- Public risk pools and government agencies, where the limit is often set in the request for proposal (RFP).
How is $3M built?
A primary policy pays first. An excess layer pays after the primary limit is used up. "$1M xs $2M" means $1M above the first $2M.
Compared with $2M for loss control consultants, $3M adds one more $1M that may be placed as an excess layer. Moving from $1M to $3M may mean a second policy.
Option 1: one policy
Option 2: $2M plus excess
Option 3: $1M plus excess
The excess should follow form, and every layer should share the same retroactive date and the same insured business name (the named insured). Loss control work may be written on a Miscellaneous Professional Liability form, depending on the carrier. Licensed engineers who sign engineering work may need an Architects and Engineers (A&E) form instead.
If you already carry $1M or $2M, Morrow can request new quotes for a $3M primary or for excess above your limit, keeping your retroactive date and coverage for past work (called prior acts) where the market allows. A commercial umbrella almost never counts (here is why).
Good to know
Check the injury gap at every layer. A missed hazard can be tied to a fire or an injured worker. Many Professional Liability forms exclude bodily injury and property damage, and follow-form excess copies that exclusion. General Liability policies for survey work often carry a professional services exclusion too, so some injury claims may fall under neither policy. See Professional Liability vs. General Liability.
What will underwriters ask for?
Each carrier in the tower may ask about:
- Your services: underwriting surveys, fire and property reviews, process safety reviews or safety audits.
- The sites you survey, such as refineries, chemical plants, large construction projects, warehouses or habitational buildings.
- Whether you only report conditions, or also design programs, recommend fixes or sign off on compliance.
- Revenue by client type and the $3M contract clause.
- Loss runs (a report of past claims), any known incidents and your current policy with its retroactive date.
What affects the cost?
- Hazard level. Surveys of energy, chemical and heavy industrial sites often cost more to insure than office work.
- Scope of advice. Designing programs or certifying compliance usually carries more risk than reporting conditions.
- How the $3M is built. The primary layer often costs more per $1M of limit than excess layers above it.
- Claims history. Past claims can raise the price or limit offers.
- Retention and defense terms. Retention works like a deductible. Defense costs paid outside the limit usually cost more.
Frequently asked questions
Do I need $3M Professional Liability as a loss control consultant?
Only if your contract or client requires it, so check the insurance clause first. Hypothetically, a fire follows a plant survey that missed a sprinkler problem, and the insurer says it would have required repairs.
Is $2M enough if my contract says $3M?
Usually not, if the clause says "not less than" $3M. A $1M excess layer above a $2M primary policy, or a $3M primary policy, may meet it. Confirm with the client that primary plus excess meets the clause.
Does defense count against my $3M?
Often, yes. Many Professional Liability policies pay defense costs inside the limit, so legal bills reduce what is left for a settlement. See defense inside or outside the limit.
Can my client be added as an additional insured on my Professional Liability?
Usually not. Clients generally cannot be added as an additional insured on Professional Liability. Many clients accept a certificate of insurance (a one-page summary of your coverage) that lists each layer, but check your contract.
