Litigation support consultants can meet a $3M Professional Liability (E&O) requirement with one $3M primary policy or a smaller primary plus follow-form excess.
The short answer
- A $3M requirement means your Professional Liability (E&O) pays up to $3M per claim and per policy year. You can meet it with one $3M primary policy or a primary plus a follow-form excess layer.
- $3M is high for this field and often comes with large, high-stakes matters. A follow-form excess layer is a second policy that sits on top and uses the primary's terms.
- $3M is rarely available online and is usually placed through a broker. Morrow can help you find it.
What does a $3M requirement mean for litigation support consultants?
Professional Liability (E&O, short for Errors and Omissions) covers claims that a mistake in your work cost a client money. A $3M clause might read:
Illustrative contract wording
Consultant shall maintain Professional Liability insurance covering the litigation consulting, damages analysis, e-discovery and trial support services under this Agreement, with limits of not less than $3,000,000 per claim and $3,000,000 in the annual aggregate. Coverage shall be kept in force for three (3) years after final resolution of the matter.
Illustrative example only. Your contract's wording controls.
- Per claim and aggregate: the most paid for one claim, and for all claims in a policy year.
- Claims-made: Professional Liability almost always covers claims made and reported while the policy is active, for work after the retroactive date (the earliest work date covered).
- "Final resolution": appeals can add years, so you would usually renew every layer.
- Excess not addressed: confirm with the client that primary plus follow-form excess meets the clause.
Who asks litigation support consultants for $3M?
The limit usually tracks what is at stake in the case. Requests tend to come from:
- Large law firms staffing class actions, mass torts or patent trials.
- Corporate legal departments that set one limit for every matter vendor.
- Courts and agencies buying case management or trial technology work, often setting the limit in the request for proposal (RFP).
- Prime vendors on large review projects who pass their limits down to subcontractors.
How is $3M built?
A primary policy pays first. An excess policy pays only after the primary limit is used up. "$1M xs $2M" means a $1M layer above the first $2M. Compared with $2M, $3M adds a full extra million for large matters and usually needs a broker. Morrow can help you find it.
Example A: single policy
Example B: two layers
Example C: two layers
The excess should follow form, meaning it uses the primary policy's terms. Layers usually share the same retroactive date and insured business name, and their policy periods should line up.
Many litigation support firms buy Miscellaneous Professional Liability, though the right form depends on your services. A lawyer on your team who practices law usually needs a separate lawyers professional liability policy. If you host or process review data, you may also need Technology E&O (for software and data services) and Cyber (for data breaches). A commercial umbrella almost never adds Professional Liability limits.
Good to know
Defense costs can shrink the limit. Many Professional Liability policies pay defense costs inside the limit. A long dispute could use up part of the $3M before settlement. See defense inside or outside the limit.
What will underwriters ask for?
- Revenue split by service (jury research, graphics, damages analysis, e-discovery).
- Whether anyone at your firm testifies in court.
- Case types you support and the amount in dispute on your largest matters.
- How you check privilege calls and calculations before work goes out.
- Where case data is hosted, who can reach it, and how you vet subcontractors.
- The $3M contract, your engagement letter, three to five years of loss runs (a report of past claims), and your current policy.
What affects the cost?
- Service mix. Damages work, testimony and large document reviews usually cost more to cover than graphics or trial logistics.
- Size of the matters. Bigger amounts in dispute can mean bigger losses.
- How the $3M is built. The primary layer usually costs the most per $1M. Excess is usually priced lower.
- Claims history and controls. Past claims can raise the price or shrink what a carrier offers. Documented checks of privilege calls and calculations may show good controls.
- Retention and defense terms. A retention is the amount you pay on each claim before the policy pays, like a deductible. A higher one usually lowers premium, and defense outside the limit usually costs more. See cost factors.
Frequently asked questions
Do I need $3M Professional Liability as a litigation support consultant?
Only if your contract or client requires it. Large matters, class actions and RFPs often set $3M, so check the insurance clause in your engagement letter.
What kind of claim could reach $3M for a litigation support firm?
A mistake on a large matter that causes a big client loss could. In a hypothetical example, a formula error in a damages model is caught at trial, the analysis is excluded, and the client blames your firm.
I have a $1M or $2M policy. How do I reach $3M?
Request new quotes through Morrow, either a new $3M primary policy or excess layers above a primary. Morrow can ask carriers to keep your retroactive date and prior acts coverage (cover for work done before the new policy starts) where the market allows. Report anything that could become a claim to your current carrier before that policy ends.
Can the law firm be added as an additional insured?
Usually not. Additional insured status is not standard on Professional Liability policies, which respond to claims against you for your own work. Many clients accept a certificate of insurance (a one-page proof of coverage) listing every layer, with each policy number, limit and period.
Looking for $3M in Professional Liability? Morrow can help.
Send us the insurance requirement from your contract and your current policy. Morrow can review both and request quotes for a $3M primary policy or a primary and excess structure, keeping your retroactive date where the market allows.
