For trainers, coaches, doulas and other wellness professionals: a $2M requirement usually means $2M per claim and $2M aggregate, so a $1M/$2M policy may not meet it.
The short answer
- A $2M requirement usually means $2M per claim and $2M aggregate, so a $1M/$2M policy that pays only $1M on one claim may not meet it.
- $2M is uncommon for individual trainers, instructors and coaches. It usually comes from larger clients.
- If you carry $1M today, request new quotes for $2M through Morrow. A true $2M per claim limit can take more searching than $1M, depending on your type of work. Morrow can help you find it.
What does a $2M requirement mean for health and wellness professionals?
Professional Liability (E&O, short for Errors and Omissions) covers claims that your advice or services cost a client money. For example, a corporate wellness client could say your nutrition program missed the results your contract promised. Injury claims usually fall under General Liability or a fitness or instructor form with bodily injury, not coaching E&O. A $2M clause may read like this:
Illustrative contract wording
Provider shall maintain Professional Liability insurance with limits of not less than $2,000,000 each claim and $2,000,000 annual aggregate. If written on a claims-made basis, coverage shall remain in force for two (2) years after this Agreement ends.
Illustrative example only. Your contract's wording controls.
- Per claim and aggregate: the most the policy pays for one claim, and for all claims in the policy year. This clause asks for $2M on both.
- Check the certificate. A certificate of insurance (a one-page proof of coverage) may show "$2M" that is only the aggregate.
- Claims-made or occurrence: Coaching, consulting and placement policies are usually claims-made, meaning they cover claims made and reported while the policy is active. Many trainer and hands-on wellness policies are occurrence-based, covering incidents during the policy period. Check your declarations page.
- Not medical malpractice: This article is for non-medical work. Licensed clinical providers, such as nurses or therapists, usually need a malpractice policy.
Who asks health and wellness professionals for $2M?
Many clients ask for $1M Professional Liability for health and wellness professionals. $2M can come up for individual trainers, instructors and coaches. It often comes from larger clients:
- Gym and studio chains hiring independent trainers or instructors, whose contractor agreements may require $2M each claim.
- Corporate wellness programs bringing in coaches or yoga instructors for employees.
- Hospital-affiliated programs hiring healthcare consultants or wellness vendors.
- Health plans and senior living communities using health coaches or placement agencies.
How is $2M built?
Many wellness professionals buy a package with General Liability (for injuries and property damage) and Professional Liability. A $2M per claim primary policy (the policy that pays first) at $2M/$2M is available from some markets, but not most standard small-business packages, so it may take a different market than a $1M/$2M package.
Where an excess market is available (uncommon for this class), a $1M primary plus a $1M excess layer (a second policy that pays after the first limit is used up) may work. Many clients require one $2M primary instead. The excess should follow form, meaning it adopts the primary policy's terms and retroactive date (the earliest date of work a claims-made policy covers). Confirm with the client that primary plus follow-form excess meets the clause. A commercial umbrella (a policy that adds limits above your General Liability) almost never counts toward this limit. Good to know
Watch the retroactive date. This applies to claims-made policies only. A new policy dated today may not cover services you already gave. Before switching, report known incidents to your current carrier. A new policy usually excludes them.
What will underwriters ask for?
An underwriter is the person at the insurer who decides whether to offer coverage and on what terms.
- Your services and revenue share from each, such as training, coaching or placement.
- Certifications held by you and your staff, and where you work: client homes, studios, hospitals or online.
- Client waivers, intake forms, written scope of services and the contract asking for $2M.
- Loss runs (a report from your carrier listing past claims), known incidents, and your current policy, including whether it is claims-made or occurrence.
What affects the cost?
- Type of work. Hands-on work often costs more than online coaching.
- Number of people covered. More instructors usually cost more.
- Claims history. Prior claims can raise the price or limit offers.
- Retention. Retention is the amount you pay per claim before the policy pays. A higher one usually lowers premium.
Frequently asked questions
I carry $1M Professional Liability as a wellness professional. How do I get $2M?
Request new quotes through Morrow: a new $2M primary policy or, where available, an excess layer above your $1M. Availability depends on your type of work and claims history. Morrow can help you find them. If your policy is claims-made, ask for your retroactive date to carry over, plus prior acts coverage (cover for work done before the new policy starts), where the market allows.
Can a gym or hospital be added as an additional insured on my Professional Liability?
Usually not. Most Professional Liability policies do not let you add a client as an additional insured (adding someone to your policy so it protects them too). It is more common on General Liability. If your contract asks for it on Professional Liability, send the contract and your current policy to Morrow so we can review them.
Does Professional Liability pay my legal fees on top of the $2M?
Often not. Many Professional Liability policies pay defense costs inside the limit, so legal fees reduce what is left to settle a claim. The declarations page (the summary at the front of the policy) shows how yours works.
What should I send Morrow to get quotes?
Send the contract page with the insurance clause and your current policy, including the declarations page. Morrow can review both and request quotes.
Looking for $2M in Professional Liability? Morrow can help.
Send us the contract requirement and your current policy, if you have one. Morrow can review both and request quotes for a $2M Professional Liability policy, keeping your retroactive date where the market allows.
