For environmental consultants whose client or lender wants $5M, this usually means $5M per claim and $5M in total per year, often built from a primary policy plus excess.
The short answer
- A $5M requirement usually means $5M per claim / $5M aggregate: the most paid for one claim, and for all claims in a year. It is a high limit for small and mid-sized firms.
- Environmental consultants often buy combined professional and pollution liability. Check the $5M applies to both parts.
- $5M is very rare online. You will almost always need a broker who can ask specialty insurers, including those that write excess (extra limit above a first policy), for quotes. Morrow can help you find it.
What does a $5M requirement mean for environmental consultants?
Professional Liability (E&O, for Errors & Omissions) insurance can help when a client says your advice cost them money. Environmental firms often add pollution coverage. The professional part responds to claims that your advice or reports were wrong, including a missed finding. The pollution part may respond when your own field work, such as drilling, causes a release. A $5M clause often reads like this:
Illustrative contract wording
Consultant shall maintain Professional Liability and Pollution Liability insurance with limits of not less than $5,000,000 each claim and $5,000,000 annual aggregate. If written on a claims-made basis, the retroactive date shall precede the first services performed, and coverage shall continue for five (5) years after completion of services. Limits may be met through primary and excess policies.
Illustrative example only. Actual contract wording varies.
- Per claim and aggregate: the clause sets both. See how limits are written.
- Claims-made: the policy covers claims made and reported while it is active. The retroactive date is the earliest date of work the policy covers.
- Five years after the work ends: environmental problems can surface late, so contracts ask coverage to continue.
- Primary plus excess: if the clause is silent, confirm with the client that primary plus follow-form excess meets it.
Who asks environmental consultants for $5M?
Smaller firms are often asked for lower limits, such as $3M. $5M is a step up, and $10M can be asked for on very large deals. The ask usually comes from the size of the deal, not your firm. Common sources:
- Lenders relying on your Phase I site assessment (a review of a property's past use and contamination risk) for a large loan
- Real estate investment trusts (REITs) and large owners buying or selling property portfolios
- Developers of large or former industrial sites
- Public agencies that write the limit into a request for proposal
Hypothetical: a lender relies on your Phase I report. After closing, the owner finds solvent contamination the report did not flag and claims the report missed it.
How is $5M built?
A primary policy pays first. An excess policy pays only after the primary limit is used up. "$3M xs $2M" means a $3M layer above the first $2M. Layers like these are very rare online and usually need a broker. Morrow can help you find them.
Example A: single policy
Example B: two layers
Example C: two layers
The excess should follow form, adopting the primary policy's terms. Every layer should share the same retroactive date, policy period and insured name. Many Professional Liability policies pay defense costs inside the limit, so confirm how each layer treats defense. Also ask whether pollution and professional coverage share one limit.
What will underwriters ask for?
An underwriter decides whether to offer coverage and on what terms. Expect questions like these:
- Revenue by service: Phase I and Phase II assessments (sampling and testing after a Phase I review flags concerns), remediation design, asbestos, lead or mold surveys, and litigation support
- Whether you only advise, or also oversee cleanup or run field crews
- How you use subcontractors, drillers and labs, and whether they carry insurance
- Whether you handle waste or work on active sites
- Who relies on your reports and whether you issue reliance letters (letters that let a third party, such as a lender, rely on your report)
- Five years of loss runs (a report listing past claims), your retroactive date, and your standard contract, including any limitation of liability clause (a cap on what you owe)
Good to know
Read the contract language. Some clauses ask you to "indemnify" (repay) a client beyond your own negligence. Policies often limit this. Ask the broker to check this wording.
What affects the cost?
- Services and revenue. Remediation design and oversight usually cost more to insure than desk reviews.
- How the $5M is built. The primary layer usually costs the most per $1M of limit.
- Claims history. Past claims can shrink the limit offered and raise the price.
- Retention and defense terms. Retention works like a deductible, and a higher one usually lowers premium. Defense outside the limit usually costs more.
Frequently asked questions
Can I get $5M Professional Liability (E&O) as a small environmental consultant?
Sometimes, but it depends on underwriting and approval is not assured. Some firms reach $5M through a smaller primary plus excess. That usually needs a broker. Morrow can help you find them. A clean claims history often helps.
Can I use my commercial umbrella to reach $5M as an environmental consultant?
Almost never. A commercial umbrella usually excludes professional services and pollution. You usually need a higher primary limit or follow-form excess. Read more on umbrellas.
Can my client be added as an additional insured on my environmental consulting policy?
Usually not on the Professional Liability (E&O) part of the policy. The pollution part may allow clients or lenders to be named as additional insureds (added as covered parties), depending on the carrier, so ask about it. Many clients accept a certificate of insurance (a one-page proof of coverage) listing every layer.
