For credit counseling firms asked to carry $2M: the policy usually must pay $2M per claim and $2M for the year, so a $1M/$2M policy may fall short.
The short answer
- A $2M Professional Liability (E&O) requirement usually means your policy must pay up to $2M per claim and $2M aggregate (all claims in the policy year).
- A $1M/$2M policy pays only $1M on any one claim, so it may not meet the clause.
- If you carry $1M today, request new quotes for a $2M policy through Morrow, keeping your retroactive date where the market allows.
What does a $2M requirement mean for credit counselors?
Professional Liability (E&O) pays when a client says your advice or services cost them money. A $2M clause might read:
Illustrative contract wording
Agency shall maintain Professional Liability (Errors and Omissions) insurance covering the credit counseling, debt management plan and housing counseling services under this Agreement, with limits of not less than $2,000,000 per claim and $2,000,000 annual aggregate. If written on a claims-made basis, coverage shall be maintained for three (3) years after this Agreement ends.
Illustrative example only. Your agreement's wording controls.
- Per claim and aggregate: the most the policy pays for one claim, and for all claims in a policy year. Here, $2M each. See Professional Liability limits explained.
- Check the split. A certificate that says "$2M" can hide a $1M per claim limit.
- Claims-made: Professional Liability almost always covers claims made and reported while the policy is active, for work done on or after the retroactive date (the earliest date of work covered). The sample asks for three years after the contract ends, so plan for renewals or a "tail" (extended reporting period).
Who asks credit counselors for $2M?
Many partners ask for $1M (see $1M for credit counselors). A $2M requirement may show up when the partner is larger or refers many people at once. Common $2M requests come from:
- Larger banks, credit unions and card issuers with hardship referral programs.
- National employers and benefits platforms.
- Housing programs that fund foreclosure prevention counseling.
- Lenders and fintech firms that build counseling into a loan product.
- Large counseling agencies that subcontract work to your firm.
Requests for $3M or more are rarer, are rarely found online and usually need a broker. Morrow can help you find them.
How is $2M built?
At $2M, the limit is often one primary policy (the policy that pays first) written at $2M per claim and $2M aggregate. Credit counselors often buy Miscellaneous Professional Liability. It fits service firms with no policy type of their own. Nonprofit agencies may get this cover inside a nonprofit package policy. Some firms reach $2M with a $1M primary and a $1M excess layer, which is extra coverage that pays after the primary. It should follow form, meaning it uses the same terms. Confirm with the client that primary plus follow-form excess meets the clause.
A commercial umbrella almost never covers Professional Liability, so it usually cannot fill the gap (see Does an umbrella cover Professional Liability?). Additional insured status (being listed on your policy as covered) is not automatic on Professional Liability. Some carriers add it only by a policy change, often limited to the partner's liability from your services. A certificate of insurance (a one-page proof of coverage) does not create it. If your contract asks for it, read the clause closely.
Good to know
What a claim might look like (hypothetical). A payment system error holds a month of plan payments, clients get late fees, and several file claims. Or a housing counselor misses a lender deadline, and a homeowner blames that for losing a home. Many policies pay defense costs inside the limit, so legal bills can use up much of the $2M (see defense costs inside or outside limits).
What will underwriters ask for?
An underwriter decides whether to offer coverage and on what terms. Expect questions like:
- Services and revenue from each: budgeting, debt management plans, housing counseling, student loan help, bankruptcy education.
- Active plan clients, monthly payments to creditors, and whether you do debt settlement.
- How plan money is held, who reconciles it and how often, and whether you carry crime coverage (insurance for stolen money). Professional Liability is not built to cover stolen funds.
- Largest partner contracts and any indemnity terms (promises to pay the partner's losses).
- Complaint logs, regulator inquiries, licenses and prior claims.
What affects the cost?
- Services mix. Debt management plans, housing counseling and any settlement work may cost more than budgeting or education alone, and some markets will not cover settlement work at all.
- Plan volume. More clients and more money moving mean more chances for a claim.
- Limit structure. A single $2M policy and a primary plus excess layer are priced differently. Defense outside the limit often adds cost.
- Claims and complaint history. Prior claims or complaints can raise the premium (the price of the policy).
- Retention. A higher retention (what you pay on each claim before the policy pays, like a deductible) usually lowers the premium.
Frequently asked questions
Do I need $2M Professional Liability as a credit counselor?
Usually when a contract, funder or partner requires it. A state license or a grant or program rule may also set insurance terms, so check those too. Send the contract's insurance section to Morrow and we can review it.
Is $1M/$2M enough if my contract says $2M?
Usually no. The clause sets what one claim can reach, and $1M/$2M tops out at $1M per claim. Read the limit wording in your contract, then ask Morrow to review it.
How do I go from $1M to $2M Professional Liability?
Request new $2M quotes through Morrow. That may be a new $2M primary policy, or a primary plus a follow-form excess layer. Morrow can request quotes that keep your retroactive date, so past work stays covered, where the market allows. Report anything that could become a claim to your current carrier before that policy ends.
Does Professional Liability (E&O) cover regulator fines or a data breach for credit counselors?
Usually not for fines, which are often excluded, though some policies help with defense costs for a regulator inquiry. A breach of account numbers is usually a claim under Cyber insurance, a separate policy for data breaches and system attacks.
Looking for $2M in Professional Liability? Morrow can help.
Send us the contract's insurance requirement and your current policy, if you have one. Morrow can review both and request quotes for $2M. Terms depend on carrier underwriting.
