$1M Professional Liability (E&O) Insurance for AI Consultants

In this guide

If a client asks your AI consulting firm for $1M in Professional Liability (E&O), one policy often meets it, but check the yearly aggregate, the retroactive date and any Cyber wording first.

The short answer

  • A $1M requirement usually means a policy that pays up to $1M per claim. Some contracts also ask for a $2M yearly total, so check both numbers.
  • AI consultants often buy Technology E&O (E&O built for software and IT services), usually with Cyber (data breach and privacy coverage). Check whether the contract names Cyber.
  • Morrow can review your contract requirement and current policy, then request quotes.

What does a $1M requirement mean for AI consultants?

Professional Liability (E&O, short for Errors and Omissions) covers claims that a mistake in your work caused a client a financial loss, such as a chatbot that gives wrong answers. A typical clause reads:

Illustrative contract wording

Consultant shall maintain Technology Errors and Omissions insurance, including network security and privacy liability, with limits of not less than $1,000,000 per claim and $2,000,000 in the annual aggregate. If claims-made, coverage shall be maintained for two (2) years after the Services end.

Sample wording for illustration only. Your contract's wording controls.

  • Per claim: the most the policy pays for any one claim. In this sample, $1M.
  • Aggregate: the most the policy pays for all claims in one policy year. In this sample, $2M. A $1M/$1M policy would not meet this clause.
  • Claims-made: Professional Liability almost always covers claims made and reported while the policy is active. The work must be done on or after the retroactive date (the earliest work date covered).
  • Network security and privacy: this is Cyber coverage. A plain E&O policy may not meet a clause that names it.

Who asks AI consultants for $1M?

You will often see $1M from:

  • Mid-sized companies hiring you for an AI roadmap or pilot.
  • Operations, sales and finance teams buying a chatbot, AI agent or automation tool.
  • Software firms and IT consultancies subcontracting LLM (large language model) work to you.
  • Clinics, health tech startups and public agencies running AI pilots. Vendors that handle patient or insurer data may be asked for higher limits.

Enterprise MSAs (master service agreements) often ask for higher Technology E&O and Cyber limits. That is the step up to $2M, covered in $2M Professional Liability for AI consultants.

How is $1M built?

At $1M, the limit is usually one primary policy (the policy that pays first), with no excess layers (extra policies stacked above it). Many AI consultants buy Technology E&O because it is built for software, data and IT services. See Technology E&O vs. Miscellaneous E&O.

Some policies pair a $1M per-claim limit with a higher yearly total, and others have matching limits. If yours has matching limits, meeting a $2M yearly total may mean a higher limit, which can cost more. Terms vary by policy and underwriting.

A commercial umbrella (extra liability coverage stacked over general liability) almost never covers Professional Liability. Clients usually cannot be added as an additional insured (a party added to your policy for protection) on Professional Liability. A certificate of insurance (a one-page proof of coverage) is the usual substitute. It shows your coverage but gives the client no rights under your policy.

Good to know

Defense costs can use up the limit. Many Professional Liability policies pay defense costs inside the limit. On a $1M policy, every dollar spent on lawyers leaves less to pay a settlement. See defense costs inside or outside the limit.

What will underwriters ask AI consultants for?

An underwriter decides whether to offer coverage and on what terms. They usually ask for:

  • Each service you offer, such as AI strategy, chatbot builds or staff training, with a rough share of revenue.
  • Which outside AI models you use, and whether you build custom models or configure tools.
  • Whether your AI touches hiring, lending, medical, legal or pricing decisions.
  • Whether you handle client data, and whether it is personal, health or financial data.
  • How you test outputs, keep a human in the loop, and get client sign-off.
  • Your contracts, revenue, prior claims, current policy and retroactive date. Check the policy for wording that limits claims tied to AI output or data use.

What affects the cost?

  • Type of AI work. Building systems that drive decisions usually costs more than advice or training.
  • High-stakes use. AI used for hiring, credit, health or legal tasks can mean bigger losses.
  • Data you handle. More or more sensitive records usually raise the price.
  • Aggregate. A higher yearly total can raise the price.
  • Retention. A higher retention (the amount you pay on each claim before the policy pays, like a deductible) usually lowers the premium.

Frequently asked questions

Do I need $1M Professional Liability as an AI consultant?

Often yes, if your client contracts require it. One hypothetical claim: a chatbot you built gives customers wrong refund terms. Even if you did nothing wrong, a policy may pay to defend a covered claim, subject to its terms and limit.

Do I need Cyber as well as Technology E&O?

It may be, if you put client data into AI tools or connect to client systems, and some contracts ask for both. Technology E&O usually responds to mistakes in your services. Cyber usually responds to breaches. Some forms combine them, so check the policy wording. See Professional Liability vs. Cyber.

Is $1M/$1M enough if my contract says $1M/$2M?

No, not if the clause sets a $2M aggregate, because a $1M/$1M policy would fall short. Request new quotes for a policy that meets the clause. Morrow can request them and ask carriers to keep your retroactive date and prior acts coverage (coverage for past work done before the new policy starts) where the market allows. Keep your current policy in force until the new one starts. Report anything that could become a claim to your current carrier before it ends.
